411 wrongly charged people set to receive compensation after release from prison

Thailand's justice minister Somsak Thepsuthin said that 411 prisoners were released after evidence proved they were not guilty of crimes. 

 

They all have the right to compensation and those who have not applied already are being sought by the ministry to inform them of their rights and help process their applications. 

 

Daily News reported that 26 of the cases were in Bangkok and 385 up-country. 

 

If they are eligible for compensation they will receive 500 baht a day for time served since their incarceration. 

 

In addition there is an up to 40,000 baht payment for hospital fees and up to 50,000 in rehabilitation fees. 

 

Loss of earnings rates are determined by provincial authorities. 

 

If a prison who subsequently was exonerated had died in prison their families would get 100,000 baht with 20,000 baht towards funeral expenses and 80,000 baht in other expenses. 

 

Somsak said that the pandemic had meant a backlog in these cases being handled.

At minimum there should be an independent body tasked with examining the evidence that convicted the people and if any malpractice unearthed then the officers involved should be duly punished. 

Who am I kidding never gonna happen if it did the MIB would be depleted by 75%

Interestingly, they all probably pleaded guilty, and did a pointy re-enactment, all in the name of Thai "justice". Because if they don't they get whacked with a 2x sentence, after having been judged t be guilty.

 

 

So is this the iceberg, or just the tip?

 

Who benefits from imprisoning innocent people?

 

And did the exonerating evidence for all 411 cases magically appear on the same day?

For the majority, it's the Thai version of Buddhism - - that is well removed from what was intended.

For some, considering these hard times, they might want to be wrongly charged and jailed again and again. Some, if not most, of the incarcerated are probably jobless and even if they're fortunate enough to be free and gainfully employed, do not make 15k baht a month.

How on earth does a person banged up in prison appeal that they were wrongly jailed ???

 

A neighbour's 28yo daughter (who has a 10yo son forcibly farmed out to family) who has served 1.5yrs for being the defacto wife of a guy (sentenced to 7yrs jail) who allegedly sold "stolen" motorcycle parts.

 

She had a full time salaried job as a Toyota cars salesperson at the time, but after numerous court appearances still copped this sentence by "association /implication with this guy (father of her son).

 

Latest is that, due to Covid19,  she may be released in a month or so on a kind of parole. Curfew after 6pm at night until morning, wear a wrist tracking bracelet and report to the local police every week.

 

How would/could she appeal?

 

Thai justice and legal system at its best !
