Former election commissioner says Move Forward leader Pita troubles have deepened

Former election commissioner Somchai Srisutthiyakorn says that Move Forward party leader Pita Limjaroenrat may be in even deeper trouble after the Election Commission (EC) decided unanimously on Friday to dismiss three separate complaints questioning his qualification to contest the May 14th election.

 

The EC, instead, decided to initiate its own probe, in accordance with Section 151 of the MP Election Act, as they think it is “evident” that Pita registered his party-list candidacy while allegedly knowing that he was not qualified to contest the poll.

 

Somchai said that the EC’s approach could land Pita in more trouble, because the commission could take the case to the police, then the prosecutors and the Criminal Court, without taking the case to the Constitutional Court, if they can prove that he was aware that he was not qualified when he registered as a candidate.

Didn't Pita give away all of his media shares well before the Election was even called and the TV station had also been shut down years ago

The EC also said, however, that there are factual and behavioural details in the complaints providing sufficient evidence to initiate a probe to determine whether Pita was fully aware that he was unqualified to contest the election when he registered his candidacy, which would constitute a violation of Sections 42 (3) and 154 of the MP Election Act.

 

Today's report by ThaiPBS:

He was vetted twice by the EC for eligibility to run in 2019 & 2023 election.

So they EC dismisses the case agai at Pita about his eligibility and then starts its own investigation to see if he knew he was ineligible after the EC twice co firmed his eligibility twice in 2019 and 2023.

 

Can we please have an investigation to see if the EC is fit for purpose? Cause from where I and many other people are standing the EC has turned into a complete shambles whose authority and respect is dwindling with every announcement they make. 

 

The EC should sue the EC for gross negligence and failure to perform its duty properly.

The EC needs to be revamped and not merely consist of seven men in their sixties and seventies who are supportive of the military and all it stands for. An element of neutrality is required for this role and if that's not possible at least representation from across the board, and that means not just cross party but age and gender as well.

 

These guys probably realise they'll lose their jobs if Pita is rightfully installed as PM. That can't be helping his case.

 Exactly. if he was not ineligible, how could he know that he was ineligible?

Really ? That is interesting.  I'd like to know more about this. Do you have a link ? 

 

Or are you talking in general terms about the qualifications an individual must have to be eligible for political office.

Well maybe he did. Maybe the conservative minority are searching and trying to prosecute any means possible to maintain their wealth and power. The people want change. These fkrs should accept it. It willl either happen or Thailand will remain a country run by the military via coups. The elite will then maintain their their wealth from where? China alone will not do this.

As for he should know better it would seem you know  the Thai political and legal system. Maybe you could enlighten us.

Do you have a source for that info because if true and no changes in share ownership/declarations between 2019-2023it took place then it changes everything, does it not!

All true. But the ruling elite make up the rules as they go to benefit themselves, of course - their history. 

If there wasn't this current Pita/media "scandal".....there would certainly be something else in the mix. 

They just can't let it go and accept inevitable.

They don't realise anything because in Thailand, an elected  government has no power on the Judiciary, and also on the semi-judiciary such as the EC, the NACC, etc...

They are completely safe, and on top of it will be rewarded at the end of their mandate by being appointed to another position.

They don't for example cover anybody who instigates a military coup, who at a minimum should be jailed for a full life sentence.

 

They don't cover those people who are incredibly rich and have low friends in high places.

 

They don't cover those UNELECTED senators, or the UNELECTED PM either, or those ministers in the cabinet.

 

They don't cover those people who tear up the constitution in have another one written in the favour and grant themselves and their cronies for all past, present and future activities.

 

They only apply selectively to the people like Pita and Thanathorn who the government don't like, don't want and are terrified of them winning.

 

They certainly don't apply to the majority of the Thai people.

Let's face it if they don't get him on this they've probably got numerous other obscure lines of attack ready in reserve. I daresay the establishment have got their finger on the pulse of how many Senators are currently leaning towards voting for him as PM if not removed, and the recently announced recounting of supposed ballot box irregularites is an attempt to counteract numbers by turning a few seats making his success impossible even if he beats the legal threat.

The systems have always been prejudicial to those who rule over the gold. Historically, they make and change the rules as in accordance to what benefits themselves. Kinda universal, ain't it....

Sure. However, in order to change it, one needs to change the Constitution, and in order to change the Constitution one needs the approval of appointed bodies such as the appointed Senate and the appointed Constitutional court, and possibly the appointed Supreme court. None of them being appointed by the elected government. It comes full circle.
