Popular Post snoop1130 Posted August 16, 2023 Popular Post Posted August 16, 2023 The Constitutional Court has unanimously refused to consider the Ombudsman’s petition seeking a ruling on the constitutionality of parliament’s decision to reject the renomination of Move Forward leader Pita Limjaroenrat for prime minister. The Court ruled that the three petitioners, two individuals who voted for Move Forward and another who was a Move Forward MP, were not the persons directly affected. The ombudsmen asked the court to invalidate the parliamentary resolution that blocked the renomination of Pita, based on a meeting regulation that the same motion cannot be submitted twice in the same session. Popular Post newnative Posted August 16, 2023 Popular Post Posted August 16, 2023 Terrible decision, with ridiculous reasoning. If nothing else, the court should have made a ruling so the proper, legal proceeding is nailed down for future PM votes. If that's there awful reasoning, Pita should submit it again, himself. 20 4 1

No real surprise there. After all who appointed the CC in the first place? Not only that but who tore up the previous constitution and had a new constitution. The minister for everything. 11 1 1 2 2
Popular Post eisfeld Posted August 16, 2023 Popular Post Posted August 16, 2023 What a bad reasoning. Of course an MP is directly affected if their leader is not allowed to become Prime Minister. And if anything it would be an important decision to clarify this point of contention. Are there so many more important questions to solve at this time than what is crucial for the countries leadership? Is this playing a technicalities game? 7 4

Popular Post cleopatra2 Posted August 16, 2023 Popular Post Posted August 16, 2023 The ruling has very little effect. Pita can be renominated as long as the renomination is not the same . Thus if PT nominate their candidate then MF can nominate Pita because the resolution will be different from the previous.(Pita was the sole nominee, now the facts are different). 3 1

It does not address the constitutional question if the House can stipulate requirements for a PM to be put up for vote that are more restrictive than the rules that the Constitution stipulates. If the court was to rule that it did violate the Constitution then any interim vote for another candidate that might succeed could be contested and make the situation even messier. A very important question to clarify before further votes take place imho. 3 2 2
Popular Post eisfeld Posted August 16, 2023 Popular Post Posted August 16, 2023 I think MFP need to change their legal advisors. They keep getting nailed on trivial technicalities that should have been avoided. They can't afford that when the stakes are so high. 1 2 1

It are not the legal advisors it are the not independent judges...A Civil PM they don't want just a a civil party to Govern... Judges are appointed by the junta and will do everything always in favor of them.. Ever seen that Mr Prayuth got a ruling against him?? Never..Thailand need changes so much 5 9 2
Popular Post lordgrinz Posted August 16, 2023 Popular Post Posted August 16, 2023 So PT may get more than one try at PM, or do they fizzle out after one try? Would have been nice if they at least answered the question brought before them, instead we get ambiguity. Amazing Thailand! 4 3

seajae Posted August 16, 2023 Posted August 16, 2023 nothing new, the ones that give out the positions and the "cake boxes" will always get their way, once again we see the corruption in Thailand fully out in the open, last thing these people want is an honest government that will stop all their graft. The only way it will end is if the people stop voting for the BS parties that are only in it to get their snouts in the trough and vote for the only decent thai political party so they have the seats to win the PMs position 2

webfact Posted August 16, 2023 Posted August 16, 2023 Court Denies Pita A Second Chance Of Being Named PM By Thai Newsroom Reporters Move Forward leader Pita Limjaroenrat. Photo: Matichon. THE CONSTITUTIONAL COURT today (Aug.16) dropped a petition seeking a court judgement as to whether Move Forward leader Pita Limjaroenrat may be legally given a second chance of being named prime minister, thus automatically denying it. The Constitutional Court judges reached an unanimous decision to waive up the case earlier filed by the Office of the Ombudsman, practically denying Pita the second chance of being named and voted prime minister following the May 14 election which has turned his Move Forward into the country’s No.1 largest elected party. For the first time last month, Pita had been named head of a post-election government but failed to get adequate support from among MPs and senators. The Ombudsman had sought a ruling on a House/Senate vote last month to deny him a second chance to be named and voted prime minister on grounds it violated Article 42 of House regulations. The Constitutional Court told you that you need to petition them yourself. Why wouldn you forego this opportunity? Why would you think the Parliament will resolve the issue for you if it was the Parliament who created the issue for you in the first place? I don't understand the strategy at play here. Anyone got an explanation? 1
