Well, IMO there would have to be an exit stamp!  That might have some reference to a ban written on it.

Sorry, but your friend would most definitely have had an immigration stamp placed in his passport indicating that he had been deported from the Kingdom.  It would be red, rectangular and take up almost half a page of his/her passport.  The stamp would be in Thai and provide details under which section of the Immigration Act he/she was deplored.  The deportation stamp will not indicate if he/she has been banned from entering the Kingdom.

 

I suspect, given the information that you provided in your original post, he/she would have used Section 12.7 which basically states:-

 

"Having behaviour which would indicated possible danger to the public or likelihood of being a nuisance or constituting any violence to the peace or safety of the public or to the security of the public or to the security of the nation , or being under warrant of arrest by competent officials of foreign governments".

 

With regards to the question whether or not your friend is banned from entering the Kingdom, I would say that there is a very high probability that he/she is on a list of 'undesirable' persons.  Again if he/she attempts to enter the Kingdom the Immigration Officer will most likely refuse entry based upon Section 12.11 which basically states:-

 

"Being deported by either the Government of Thailand that of or other foreign countries ; or the right of stay in the Kingdom or in foreign countries having been revoked ; or having been sent out of the Kingdom by competent officials at the expense of the Government of Thailand unless the Minister shall consider exemption on an individual special case basis".

 

The Immigration Officer can also refuse entry as per Section 12.7, as indicated above, given your friends past history.

 

FYI... It is often suggested that persons' in similar situations to your friend should get a new passport, and if possible change their name.   Sorry but the immigrations systems used throughout the world (including that used by Thai Immigration) are more than capable of matching up previous/current passports.

His guy already said the relationship was heavy, dude, and they were both tooling one another up, so I think we can garner from that that he is no Mark Poppins. Thailand already has enough issues with troublesome farangs. He might have a stamp in passport, a doc, both or none. But if he must I would get a Thai to call immigration in Bkk and drill down. Probably best not to ask his misses though.

He is not only married, but the girlfriend has also later died, so she is no longer

He served 4 months in a Thai prison. Sounds to me like this guy got deported.  He'll have trouble getting back into LOS.  Getting a Thai lawyer to sort it out is probably his best starting point.

Please give your (friend's) definition of "deported."  Was he escorted out with the police holding his passport until he boarded a plane?  Was he held in IDC at the airport until his flight?  Or was he simply told he needs to leave ASAP, and he left on his own.

 

And please post the exit stamp your friend had entered into his passport when leaving.

Absolutely correct.

I know of a person with a Thai wife, arrested, charged with fraud, deception, and overstay, held in IDC for 4 weeks and appeared in court.
He was fined 10K for fraud and 20K for overstay. That was 4 years ago.
His stamp indicated he was deported under section 12.7

 

He states he received nothing from the Court, nor any indication as to how long he had been banned from re-entry.
As the overstay was for more than 1 year, he wrongly assumed it was a 3-year ban.
Last year he booked a flight to Thailand, but at check-in was informed he was blacklisted and would be refused entry, therefore he was denied boarding.
His wife has since approached Immigration, without reply, so they employed a lawyer.
The lawyer initially assumed he'd been banned for 10 years as he was arrested before deportation, but Immigration advised he was banned under section 16.
Section 16 : In the instance where for reason of national welfare or safeguarding the public peace , culture , morality , or welfare , or when the Minister considers it improper to allow any alien or any group of alien to enter into the Kingdom , the Minister shall have power to exclude said alien or group aliens from entering into the Kingdom

 

He was merely referred to as being 'undesirable'.
He and his wife are trying to appeal the decision.

Then you read somewhere else on this forum about people wondering why Thailand attracts so many criminals.

When the Swiss man in Phuket kicked the lady, everybody in this forum pointing the finger, deport the farang, he is bad for our reputation.

In one way you are right, in another way, not.

 

If we knew more details, we could judge him same as we did against the swiss dude. But lack of details prevent us from that.

 

If he served his sentence, hopefully he learned his lesson. If he do it again, lock him up!

no she was not poor in any sense of the word. She was drunk like a maniac and so was he... I do not know the exact details, but they were on it both of them..... The police were called and broke them up. The sister to the lady was married to a policeman, and he came and took the falang with him to the police-station... They kept him there, tried to squeeze him for money, and he paid them 200.000 baht and then he was escorted out of the country 4 months later.......

 

In short this was the sto9ry, since then just after 3 months about after the deportation the lady died from a brain-stroke or something like that....

 

So I am interested to help this guy to come back to Thailand and take care of his properties Condo and bank-account. Besides that i do not care a <deleted> about the future of the man... But I am happy if you guys could be of help for me... I have a better copy of a earlier form that was a bit blurry..
