A challenge for Halligan
Comey’s defense attorneys are likely to argue that Halligan can’t serve as interim US attorney because that position hit its 120 day limit. Also, they may say Halligan’s new role does not appear to fit two exceptions for appointments to such vacancies under the law: She is not Senate confirmed nor is she someone who has been employed in Justice Department for at least 90 days.

 

The Justice Department will have an opportunity to argue in court to defend Halligan in early November.

Fate loves irony, nothing better than seeing an actual fraud being indicted for fraud. She knew it was coming, including why. No need for discovery, she either entered false information or she didn’t.

(Newly appointed U.S. Attorney for the Eastern District of Virginia Lindsey) Halligan was named U.S. attorney by Trump after Trump ousted her predecessor, Erik Siebert, who sources say had expressed doubts internally about bringing cases against James and former FBI Director James Comey. 

 

As ABC News first reported, sources said Siebert and other career prosecutors in Virginia determined there was no clear evidence James had knowingly committed mortgage fraud, but Trump officials nevertheless pushed Siebert to bring criminal charges against her. 

 

"It looks to me like [James] is very guilty of something, but I really don't know," Trump said to reporters in the Oval Office in September when he confirmed he wanted Siebert "out" of the job.

However, following a five-month investigation and interviews with more than a dozen witnesses, federal prosecutors uncovered no clear evidence against James, sources told ABC News.

You cannot invent something so big. So if she has cheated,  she deserves to be sacked destituted (edit).

 

That to if a DA, then the punishment needs to be twice as harsh. But as much of the ruckus in America is political, the leftist woke liberals watch over each other, so wait and see what will happen ultimately....

The legal defense fund is different. Donors won’t be subject to state laws that limit campaign contributions and require public disclosure. New York City has regulations for legal defense funds set up by elected officials, including Mayor Eric Adams, but there is no parallel system for state officials.

 

The Democratic Attorneys General Association said contributions would be routed through a 527 organization and would be disclosed in an annual filing. That kind of organization can accept unlimited donations from individuals, corporations and labor unions in order to influence policies, appointments or elections.

 

Money from the fund will cover fees incurred by Lowell’s firm. A spokesperson for the attorney general’s office said James was declining to tap a special $10 million appropriation included in the state budget for officials subject to retaliatory investigations.

Difference of course is that, if her appointment is deemed illegal, the statute of limitations has passed for Comey, not for James.

Elizabeth Yusi, who oversees major criminal prosecutions in the Norfolk office of the Eastern District of Virginia, has confided to co-workers that she sees no probable cause to believe James engaged in mortgage fraud, the two sources told MSNBC. Former Watergate attorney Nick Akerman told Newsweek moments before former FBI director James Comey’s arraignment on Wednesday, that the Department of Justice’s prosecuting attorney in the case, Lindsey Halligan, is “playing a pretty dangerous game here in terms of her law license."

 

The attorney told Newsweek it’s possible that the bar will initiate an investigation into Halligan over the matter, which could result in her disbarment.

I had a thought that maybe a Trump supporter on here may say 2 wrongs don't make a right. Oh well.

Letitia James case against Trump was the one case that gave off vibes of vindictiveness - it likely sullied opinions on other cases against Trump that had real merit. I'm no lawyer but what you hear indicates this will fail for all sorts of reasons and will leave Trump looking silly. He may not care as he  likes to put people in harms way just because he can ... and his supporters often go along with it just because..

Trump's secretary of the treasury did exact same thing. Another cabinet member claimed THREE 'primary residences'. Her second house cost all of $137,000... 

She should easily beat this due to it being a 'vindictive prosecution'... Trump has no ability to moderate his mouth, and all evidence she needs he has provided. Same thing with Comey, and having his bimbo go after her strengthens  both of their cases.

So go after more of those who oppose you. Every one increases probability of case being dismissed.

MAGAs use the buzzword the far right fascist media gave them (lawfare) to diss any investigation of actual lawbreaking. No MAGA has ever been able to explain why a guy running a wedding planner facility and a country club needed highly classified documents including HCS (Human Clandestine Sources) that have the actual names of foreigners who risk their lives and the lives of their families by cooperating with US intelligence. Nor why a private citizen needs TS/SCI, SAP, Codeword, RD, etc. docs in a club where anyone with $200,000---including Chinese MSS ops officers---can join.

 

Neither can any MAGA explain why Trump tried to browbeat the Georgia SecState into "just find me...11,780 votes", despite being told repeatedly that the votes had been counted and recounted and Trump lost Georgia.

 

MAGAs cannot give any possible rational reason what Trump would summon his goobers to DC for 6 January 2021, Tweeting "It'll be WILD !", nor offer any reason why Trump would tell them to fight (37 times in his speech) and march to the Capitol. Either Trump is an insurrectionist and seditionist and tried to overthrow US Democracy, or MAGAs are arguing that Trump is an absolute idiot who couldn't possible have known his goobers would turn violent. Personally, I think Trump is an anti-US, self-serving, vindictive clown who is also an absolute idiot (38th percentile on his SATs doesn't scream "stable genius").

 

The clown who now barks about Democrats being "gnats we need to take care of", while addressing US sailors, thinks trying to hang the Vice President and beating 140 Capitol police officers are not only pardonable, but anyone who was convicted should be compensated for it and anyone who investigated and prosecuted those terrorists should be fired. MAGAs cannot explain that, at least using any sort of rational argument.

 

A jury of his peers convicted Trump of 34 felonies, and all Trump did was doxx the judge and the judge's family, knowing full well his goobers are more than capable of attacking anyone Trump states is an enemy.

 

A civil jury of his peers convicted Trump for sexual assault, and had E Jean Carroll been successful in getting a sample of Trump's DNA, it could have been compared to the semen stains on the dress she wore on the day of the sexual assault, and which she never laundered, to prove Trump did what she alleged. The jury found sufficient evidence regardless and convicted Trump of sexual assault.

 

That isn't "lawfare", it's simply law. And justice.

 

Trump's attempt at retribution is already blowing up in the case of Comey, as his Carnival People embarrassed themselves in court on Wednesday. Their one "witness" said Comey never leaked anything classified. If it is merely Trump's attempt to embarrass Comey by having him arraigned, it will just make Trump look like the vindictive child rational people already know him to be, and Comey will just smile come out looking better than he ever has. So will James.

 

Even with the blocking of the legitimate and serious cases against Trump, who would likely have been convicted for the stolen documents case (and lying about returning everything), and possibly even convicted for his 6 January insurrectionist behavior, it's still Trump 34, Comey + James 0.
