JohnBoy2098 Posted May 13, 2017 Posted May 13, 2017 Hi I hope I am in the correct forum, I was pulling out of my drive onto the main road when a thai girl on a scooter crashed into the side of my bike, we both had helmets although she was holding her head, no blood I had a swollen wrist and some scratches, the police arrived and asked if everything was ok, I said everything was fine and I had a friend who could repair the scooter at his shop, they told myself and the thai girl they would escort us to the shop, I explained the accident to my friend who said he would do the repairs and I could pay the bill later. I was then told that I needed to help the girl with her medical I explained I had insurance and would go to the hospital to get it sorted, originally they agreed but then said she also has insurance but I need to give her 1000 baht and I did not have to go to the hospital so I gave her the money apologised and she left with her friends in a car. I went back to the shop a few days later to pay for the damage to the scooter, my friend said the girl had been to the shop and told him she had 2 scans and needed another one but her insurance would not pay and I would need to pay for another scan 7000 baht, which seems a lot for an x-ray and if she was out and about then the bump on the head cannot be that bad just not sure where I stand, the police did not take any notes or ask for any paperwork they drove so far and then left. my bike has a green book its taxed, insured and I have accident insurance, which I offered to use.
worgeordie Posted May 13, 2017 Posted May 13, 2017 The 7000 THB could have been for an MRI which will be a lot more expensive than an X-ray, it was your fault, check with the hospital regarding price of X-ray or if its an MRI but maybe best just to let your insurance sort it. regards Worgeordie

I dare to say any cash in hand will never go towards any scans....! I think if you mention insurance and police the claim for extra scan might disappear or reduce anyway ...

robblok Posted May 14, 2017 Posted May 14, 2017 By the look of it you were guilty anyway.. you pulled out onto the main road.. means in general your guilty. So let your insurance sort it out what the insurance does not pay you have to pay.

Why do you have insurance when you are prepared to pay out cash * The only recall for her for cash would be lost wages - that may come latter after seeing how long it takes for the 7000

And in private clinic I payed 3500 Baht for MRI of head (brain). I would not pay anything unlest I saw a real medical bill. You'll give her money once and you can be sure, that she will come back again. As long as you're going to give her money she will be coming back... .

JohnBoy2098 Posted May 14, 2017 Author Posted May 14, 2017 Thank you for replies, yes it was my fault I was not disputing that, I thought it a bit odd that they did not want me to go to the hospital with them, I have been sent a photo of the hospital bill, it looks like she went to a private hospital rather than the government hospital they said they were going to, the receipt states she spent 4 nights in hospital amounting to some 27000 baht which was covered by her insurance, I appreciate a bump on the head can be serious, however there was no blood, she wore a helmet and she was able to ride 5km to the bike shop. I could have used my insurance on the day of the accident but a week later they will not cover and asked why it was not used on the day. I am going to ask one of the Thai staff in work to speak with her to see if they can get this sorted out, as mentioned already it will be 7k this week and another 7k next week etc

I wonder if Thais, specially police, know all of this, so keep this plan of say no need for getting insurance or police involved, and pay a little and all will be good, but come back later to milk farangs... I would want a signed agreement of satisfaction that says no further claims are coming or valid if they want to shake hand on the day.... Even that probably is not worth much later in LOS when farangs are involved.

cracker1 Posted May 14, 2017 Posted May 14, 2017 I think you will find when you paid your registration for your motorbike, you also paid for medical insurance for the girl you hit. I think it is limited to about 50,000 baht, but that sounds like it will cover the problem you have at this time. Good Luck

It was your fault and if worse it could have cost you 10's of thousands .... why are you questioning $200 to have the whole thing finished and to go away .. geeez pay it, give her a bunch of flowers and learn a lesson.
