Supreme Court Jails Redshirt Leader For Defaming Former PM

BANGKOK — The Supreme Court overturned two lower court rulings Thursday to sentence Redshirt leader Jatuporn Prompan to a year in prison for defaming a former prime minister and political rival.

 

In its decision, the court found Jatuporn guilty for a 2009 speech delivered to an audience of thousands in Bangkok in which he accused former Prime Minister Abhisit Vejjajiva of ordering soldiers to kill Redshirt supporters earlier that year at a protest in Bangkok’s Din Daeng district.

Jatuporn gets one year jail for defaming Abhisit

BANGKOK: -- Jatuporn Prompan, chairman of the red-shirt group, has been handed a one-year jail term for defaming former prime minister Abhisit Vejjajiva in speeches he made in 2009.


The Supreme Court on Thursday sentenced Jatuporn to one year in prison without suspension and ordered him to publish apologies to Abhisit in newspapers for seven days.

 

Abhisit had filed a case in June 2009, accusing Jatuporn, a leader of the United Front for Democracy Against Dictatorship (UDD), of defaming him in front of 10,000 people through loud speakers at Wat Phai Kiew Temple in Don Muang in Bangkok on May 10. Jatuporn had called Abhisit a “tyrant” whose “hands are tainted with blood” who deserved to be sentenced to death for killing people.

 

The Court of First Instance had rejected the case on December 27, 2012, saying that to comment was tantamount to political retaliation in a democratic system. 

 

Abhisit took his case to the Appeal Court, which upheld the first court’s ruling and rejected his plea saying comments by Jatuporn were honestly made.

 

The Supreme Court on Thursday overruled the two courts. 

 

Jatuporn  was taken to Bangkok Remand Prison on Thursday morning.

He should be in jail for his remarks and behaviour at Ratchaprasong during the red shirt occupation, as Suthep should be for his occupation more recently.

Jatupon himself said under the present rulers, the red shirt leaders would all find themselves in jail or would wind up dead. 

Perhaps there is a strategy to weaken Pheua Thai before the election. I don't think it will work though, they are going to win hands down in the north and in Issan.

Don't let the fact that he blatantly committed an offense get in the way of your attempt to twist away from the seriousness of his blatant lies.

Wonder if the UDD will hold an election to select a replacement Chairperson whilst he's in the nick?

 

Nah, one will just be mysteriously appointed, as he was, if deemed necessary.

name calling wow really bad crime. What is wrong people like you be happy over something silly like this but not care people were shot die in temple. At time abhisit  be PM if he not give order for do why he not be in court same yingluck for negligent. His army shoot nurse if he not order mean he negligent yes or no.

armed red terrorists fled into the grounds of the WAT after attacking security forces while they were trying restore order in the city, the army returned fire and some people who were strongly advised many times to leave the danger zone were unfortunately caught up in the exchange, in my book that was their choice to put themselves in danger when they were well aware they were in a live fire zone and refused to take advice and leave.

- Owner is a convicted absconded criminal.

- Chairperson now in jail.

 

But naah I guess they don't worry about their image getting in the way of their immoral activities.

 

But what do the rank and file think? Never mind, not their business, just put your mark where your told to on the ballot and everybody will be rich in six months.

Designate safe zone for women children elderly and infirm.

Udd not perfect but to many Thai choose before army. What that mean about army. You so crazy fill with hate cannot see true thing.

Jutaporn’s to get health checked before jail sentence begins, says corrections chief

BANGKOK: -- The Corrections Department will check the health of the red shirt leader, produce a criminal record, before sending him to jail, said the department chief, Kobkiat Kasiwiwat, on Thursday.

 

Jatuporn Prompan, chairman of the United Front for Democracy Against Dictatorship, has been handed a one-year jail term for defaming former Prime Minister Abhisit Vejjajiva over speeches he had made in 2009.

 

Kobkiat said if Jutaporn was sick, the department would ensure he gets medical care, but would not take him to an outside hospital. 

 

Jatuporn was ill while under detention in Bangkok Remand Prison related to another case, and received medical treatment until he got well.

 

When moved, Jatuporn should inform prison officials about his health condition so that he can get proper treatment, Kobkiat suggested.

Given that this sentence is handed down by (i believe) the highest court means he can't appeal and will  have to serve his year. Maybe he gets some time of for good behavior but at least he will be in time for a while. That will teach him not to lie. 

 

I don't like the defamation laws here, but in this case I make an exception.

This whole legal debacle should have remained a civil matter, resolved baaed on whether or not financial compensation was payable.  Any court action that enables a civil action to result in imprisonment is clumsy, heavy-handed and leaves the court system open to accusations of political interference.

BANGKOK (Reuters) - Thailand's Supreme Court jailed a firebrand opposition leader for a year on Thursday for defaming a former prime minister, overturning two previous court rulings, in 2012 and 2014, that dismissed the charge against him.

 

Jatuporn Prompan is a key leader of the "red shirt" supporters of former Prime Minister Thaksin Shinawatra and his sister, Yingluck Shinawatra, who also served as prime minister. Their governments were both ousted in military coups, in 2006 and 2014 respectively.

 

Jatuporn led street protests in 2010 when the supporters of the populist former telecommunications tycoon Thaksin occupied a Bangkok shopping district for nearly two months, calling for the then prime minister, Abhisit Vejjajiva, to resign.

 

The Supreme Court found Jatuporn guilty of calling Abhisit a murderer in a speech during the protests, which ended in bloody confrontation between the military and demonstrators in which more than 90 people were killed, most of them civilians.

 

Jatuporn's speech had not been fact-checked and had been made for political gain, causing damage to Abhisit's reputation, the court said.

 

Jatuporn did not speak to the court or to reporters, but only smiled as he was led away to jail, media reported. 

Confrontation between the Shinawatras and their legions of supporters, especially among the rural poor, on the one hand, and the military-dominated establishment, based in Bangkok, on the other, has divided Thailand for more than a decade.

 

Jatuporn won a seat in parliament in a 2011 general election, when Yingluck led the Shinawatras' party to victory. Thaksin has lived in self-exile since 2008 to avoid a corruption conviction he says was politically motivated.

 

Yingluck was ousted as prime minister days before a 2014 coup and she too faces trial in connection with accusations she mismanaged an extravagant rice-subsidy programme.

 

The military government that has ruled since the 2014 coup has moved to suppress dissent and detained critics, many of them supporters of the Shinawatras.

 

Jatuporn was already on bail for another defamation case brought forward by Abhisit and a terrorism charge in 2010.

 

The case against him was dismissed in 2012 and 2014 when courts said his speech was considered honest and democratic criticism and therefore not defamatory.

 

The government has promised to hold an election next year.

So you like bad law if use for someone you not like. This is very bad for believe this way. Better same law for everybody and if law not good for you should not want this law for anybody even enemy. Why you let hate let you make bad choice

Reuters needs to recheck its sources. He's speech was made in 2009 not in 2010.

They tried to shoot some photographers as well and, sadly, got a couple. Italy and Japan are still very keen for justice for their murdered citizens.

These are not political views.. these are just lies and that is what he is convicted for.. not for his views.

Disgraceful lies!  people were cowering there to avoid being shot by the army who eventually shot a nurse there too.

Lannaguy, Jatuporn was convict for a speech made in 2009 not for 2010 event.

Recheck your source you are so ridicules with your statements
