Registering father legitimacy at Amphur office

Recently went through the process of legitimizing my son through the courts as I was not married to his mother. We have separated.
 
I now have the judgement letter from the court but it has to be registered at the Amphur office I assume where he is registered in his mother's tabian Baan. Is it possible to register the legitimacy at my local amphur different to his TB?
 
His mother consented to the legitimacy hence it was approved through the courts. But I am very doubtful she will make the effort to go to the amphur office (it is a long distance from both of us).
 
Do I need her present to complete this process?
 
If she is prepared to go alone does my son or myself need to be present to register?
 
I assume the court judgement letter alone gives me parental rights now even without registering. What issues are there if I don't register it at the amphur?
 
Any advice from someone who has been through the process appreciated

By the way. My name appears as the father now on the Tabien Baan for what it's worth. So I am recorded on the Tabien Baan as the father and hold a legitimacy judgement. Maybe I don't need to do anymore?

You need to register the court decision with the amphur. The mother's present is not required.

 

Registration should normally be done at the amphur where the child is registered. I would guess that is the court in this case was also located in that province, but you cna always give it a try at your own amphur.

I am living in a different province to where he is registered. About 4 hours away. The lawyer seems to think her presence is required.

Her presence is not required. These orders are sometimes issued against the mother's wishes. In this situation if the mother refused to go to the Amphur the Court's order would be useless.

 

Which is exactly why she is not required to attend.

What is the benefit of registering at the amphur office apart from completing the beauracratic process? I assume the court judgement I have stating I am the father carries weight in its own right?

Even being the legitimate father in Thailand gives me very few rights that would usurp the mother. For example I believe if I want to get him a passport or move him to a new Tabien Baan I would need her signature and approval.

I take care of my son now 100%. She is in another province enjoying her single life.
My main reasons for legitimizing myself as the father was to have rights to him should his mother die as her family may want him should it be financially advantageous for them

I just helped my daughter in law go through the process of getting her son recognised as father as a LEAD UP

 to getting full custody. It looks like you have to go through more procedure to get custody, getting recognition was just the first stage. We had two visits to a family court and one visit to a superior court. 

And yes, for the custody documents to be authorised at the Amphur, the father and another family member have to be present. The father will now be getting I believe THB500 a month from the government in addition to his present wage.

Maybe you actually DO have custody rights, if you were supposed to go to the Amphur, you need to get that sorted out.

By registering it you complete the official process. Right now, only your wife knows you are the legal father per judgement of the court. Others cannot know that, as there is as of yet no official record of this. That is often not a problem, but when official proof is required you cannot produce this.

When you get a divorce, the court rules and then gives you a similar court letter BUT you are NOT divorced until you take that letter to register the divorce at the amphur which means they are inputting the information into the national government computer database.....your court letter is the same, it means nothing to anyone else except the amphur and only when you have the amphur input the information into the national database will it become legal.
