Cop defends himself over kicking charge - but lawyer says family have a witness

A traffic policeman in Ratchaburi has defended himself against charges that he kicked a teen off his motorcycle during a high speed chase. 

 

But the high profile lawyer acting for the parents of the boy says he has a witness that is prepared to testify to the contrary. 

 

The witness is a 13 year old who was on the back of the bike. 

 

Sixteen year old Anucha was driving the motorcycle with 13 year old "A" riding pillion.

 

They came off at a bend in the road outside a cemetery. Anucha hit the wall and died. It happened back in September of last year. 

 

Parents Jaree, 41, and Lamphai, 61, have hired lawyer Ranarong Kaewpetch, who fronts a justice organisation, to act on their behalf. 

 

Sanook reported that traffic cop Corporal Thanakrit Matsayawanitkul said that a 3pm he heard the sound of a souped up bike being revved up. It came out of a temple and he blocked its path.

 

But the bike failed to stop and he gave chase. He said the bike was going at more than 100 kmph and he was at a distance of 10 meters. He said at that speed and on a bend it would have been impossible for him to have kicked the teen off. 

 

Some CCTV showed the bikes closer together but CCTV at the actual scene of the accident is inconclusive showing only the aftermath of the crash. 

 

Cpl Thankrit said he was sorry for what happened but he was only doing his duty.

 

Lawyer Ranarong said that he was inclined to believe the police at first. 

 

But the thirteen year old on the bike is adamant that the policeman kicked them off.

 

He said it is a serious case of a policeman allegedly causing death and justice must prevail. 

 

But he said that the family were only after an apology from the police and were not after money.

I'm with the cop on this one. Not that I trust the cops that much, but you certainly cannot rely on the word of one of the perps.

Giving chase for this?  Must have been a crime free heavenly paradise on the night he contributed to this event.

What are the rules for a 13 year old giving evidence in court? Especially if he was involved in the incident and not just an observer?

this is not the first time that an escaping motorcycle rider get kicked off his bike.
It is the normal RTP practice to stop them. Chase, give a kick, wait for the accident.

It's now official policy for police in the UK to knock people off bikes they are chasing. Fair enough. If they are refusing to stop that might, just might, suggest they are guilty of whatever. Same as these kids refusing to stop when ordered by the police. If they weren't trying to escape the incident wouldn't have happened.

Agreed.... However, the police have been instructed that they can only take action IF the thugs are wearing helmets and the thugs have got wind of this... thus, in recent months the Thugs have stopped wearing helmets, increasing the risk of serious injury if the Police 'nudge / knock' them off their bikes... no helmet and they can 'get away'...

few years ago a policeman shot a biker who wouldn't stop right in the head from a far distance.

 

I've seen it plenty of times, the scooterdrivers won't stop...i 've even seen them all (40 of them) turn around and drive back against traffic...i've seen a copper grabbing the arm of a scooterdriver (who had a girl on the back) when he stopped, but the driver just pulled up again and off he went. Coppers didn't do anything.

 

I've also seen it many times that they don't stop at all, nothing happened.

 

The police is a complete joke to the drivers, this is the only way to get respect...kick them down.....and if mummy has a problem with that she shouldn't let her young boy drive a souped up bike...period.
