(Reuters) - President Donald Trump's campaign said on Sunday it would again ask the U.S. Supreme Court to overturn results from the Nov. 3 election, its latest long-shot effort to subvert the electoral process and sow doubt over the legitimacy of President-elect Joe Biden's victory.

 

In a statement issued by the campaign, Trump lawyer Rudy Giuliani said the campaign had filed a petition asking the high court to reverse three rulings by a Pennsylvania state court interpreting the state's rules for mail-in ballots.

 

“The Campaign’s petition seeks to reverse three decisions which eviscerated the Pennsylvania Legislature’s protections against mail ballot fraud," Giuliani said in a statement.

 

Giuliani said the filing sought all "appropriate remedies," including an order allowing Pennsylvania's Republican-controlled legislature to award the state's 20 electoral votes to Trump. Biden won the state by more than 80,000 votes.

 

The petition is "frivolous" and is not going to stop Biden from becoming president on Jan. 20, said Joshua Douglas, an election law professor at the University of Kentucky.

 

"The Court will shut it down quickly," Douglas said.

 

The Supreme Court on Dec. 11 rejected a lawsuit filed by Texas and backed by Trump seeking to throw out voting results in four states, including Pennsylvania, that went for Biden.

 

Several senior Republican U.S. senators, including Senate Majority Leader Mitch McConnell, have acknowledged Democrat Biden as the country’s president-elect after the Electoral College affirmed his victory, and have rejected the idea of overturning the 2020 presidential election in Congress.

 

A candidate needs 270 Electoral College votes to win the White House. Biden won 306 of those votes to Trump's 232 and defeated the Republican president by more than 7 million ballots in the popular vote.

 

Congress will count the electoral votes on Jan. 6 and Biden will take office on Jan. 20.

 

Trump has made unsubstantiated claims of widespread electoral fraud and has tried but failed to overturn Biden’s victory, challenging the outcome in court in multiple states, while pressing state officials, lawmakers and governors to throw the results out and simply declare Trump the winner.

although they might have a chance by claiming the pennsylvania supreme court unconstitutionally overruled the state legislature by extending the mail-in ballot acceptance date, the number of mail-in ballots postmarked by election day and received by that friday numbered only a few thousand, far fewer than biden's 80k margin, and not enough to affect the results.  the remedy demanded by the kraken krew® is not warranted, thus the justices will decline.

this won't go anywhere, and is not intended to.  it's designed to keep those donations rolling in.

 

No chance.  That would require the US Supreme Court to overturn a decision by the PA Supreme Court because it violated the PA Constitution.  That's not going to happen.  I know that one of the clown justices on the US SC wanted to make just such a ruling, but the rest of the Court wouldn't hear of it.

Trump' s remedy is that the electoral vote be controlled the  majority Republican State Congress by overturning the election laws established by the same majority Republican State Congress!

If the former ("old") violated either State or Federal Constitutions, the time to challenge was when the laws were enacted. But the majority didn't 't and to date has not - perhaps it would be challenging itself!?!

As I have said before, after losing 17 businesses, some into the billions of dollars, 19 merchandising deals (just since he became president, 100% have defected), the trade war with China, and the negotiations with Kim, one would presume he is accustomed to losing. He is a loser, there is no other way to look at him. And he is sure acting like one now, more than ever.

One has to wonder what the end game is.  Surely Rudy/Trump knows this has zero chance.  Raise money?  Sure.  Rudy wants to keep getting paid for doing "something?"  Yeap.  Or could it be to give those in Congress cover for alleging some sort of malfeasance on 6 Jan?  Yeah, but it won't change anything. 

 

But that whole business regarding Trump declaring Martial Law does give pause.  I almost hope he tries it.  It may force those spineless Republicans to actually stand up to Trump.

Frivolous litigation is use of legal processes with apparent disregard for the merit of one's own arguments. It includes presenting an argument with reason to know that it would fail or acting without a basic level of diligence in researching the relevant law and facts (wikipedia). This latest Trump's shenanigan does has that notion and fall under such category. Under US Rule 11 of the Federal Rules of Civil Procedure, sanctions and fine may be imposed by the court upon party and lawyer/s for wasting court and other parties's time. Time for the court to shut down this absurd repetition of legal brain fart.

we know the congress won't deny the electors.

we know the insurrection act/marital law is a no-go.
