As he was caught by immigration so he’ll be blacklisted for 5 years (penalty is the same if it’s 1 day overstay or 1 year if you’re caught).

When surrendering at airport immigration when leaving Thailand:

  • Overstay less than 90 Days = 500 Thai baht/day overstay fine (maximum 20,000 Thai baht)
  • Overstay more than 90 Days = 1 year ban from Thailand and 20,000 Thai baht overstay fine
  • Overstay more than 1 Year = 3 years ban from Thailand and 20,000 Thai baht overstay fine
  • Overstay more than 3 Years = 5 years ban from Thailand and 20,000 baht overstay fine
  • Overstay more than 5 Years = 10 years ban from Thailand and 20,000 baht overstay fine

When caught while overstaying

  • Overstay of 1 day to 1 Year = 5 years ban from Thailand and 500 to 20,000 Thai baht overstay fine
  • Overstay more than 1 Year = 10 years ban from Thailand and 20,000 Thai baht overstay fine

How can it be negligence? I think it's deliberate and and a colonial attitude of privilege as if they own the country. If it's economic reasons I understand.

We’re all adults and capable of obeying the laws and if not then there’s nothing to complain and no one else to blame than us.

38 days isn't the end of the world, but immigration will do their job and he will be gone..

Neither does it matter, invalid visas/perm to stay is not ok even with personal circumstances.

Neither is extending the permission to stay the end of the world.  No one but himself to blame for IOs doing their job that Thaivisa posters would complain for tens of pages about if they didn't.

Better than IDC in Thailand and it was his choice.

Well the reality is, he was caught and arrested and hence can be subject to a 5 year ban on returning. People who 'surrender' can have overstayed 90 days without that penalty. Usual fine of 500 baht/day up to 20,000 maximum will likely apply. As with other crimes, ignorance of the law is no excuse......
