It depends on the issue and the extent to which the court wants to get involved.  There are to bright lines.

 

Look up the Supreme Court and the "Major Questions" doctrine.  Along similar lines, look op the "Political Question" doctrine.  Then, look up "separation of powers."  Sometimes they can't figure out a way for the judiciary to effectively manage an issue, other times they know they shouldn't be getting involved.

As more and more products that are used by millions found to be on the tariff list, Trump will most likely exempt those too and before you know it almost everything from there will be exempt or China will continue to reap trillions on those products.  Meanwhile all the things the US was sending to them have now been replaced by the products from Canada, japan, S. Korea or other countries.

Actually the most appealing part of his platform was the pledge to reduce inflation and to bring on strong economic growth.  Most Americans are not in favor of reducing taxes on the wealthy. Quite the opposite.
