Does your tenant inviting a friend to stay a few nights infringe the law ?

What address would he put on his immigration form at the airport?

 

Would this become more difficult when the digital TM6 starts, TDAC ?

In principle any foreigner staying should be registered with a TM30. If it's a private guest – not a paying customer – it should not be a problem doing a TM30-report.

We live North of Chiang Mai and have a motel and apartments which my Thai wife manages.

Most of our guests and tenants are Thai but we occasionally do have foreigners as occurred recently.

I was overseas and we had a young French guy rent for two months as he has a Thai girlfriend.

My wife was a day late lodging the TM30 form as she had to take our sick daughter to hospital in Chiang Mai where she was kept in overnight

The recently appointed officious Immigration person fined her 2000 baht for being a day late.

Wasn’t interested in the reason for the delay.

Sometimes doesn’t pay to do the right thing.

Did your wife get a receipt for the 2000 Baht?

Unless the tenant agreement states otherwise, who the tenant invites into the house is nothing to do with the landlord.

The person in physical control of the place ( the condo ) where the foreigner stays IS responsible for a TM-30 within 24 hours.  Read the Immigration Act Sections 4 & 38

 

Let's look at my LOCAL IO POLICY:

So I leave the country next month on holiday, I return and file the new """ELECTRONIC TM-6""" ( address where I will stay ) 3 days before entry, I return to my SAME ADDRESS of 4+ years - LOCAL POLICY says within 24 hours I have to file a new TM-30.

As I said many times, it ALL depends on LOCAL POLICY and LOCAL ENFORCEMENT

In this case the person renting or in POSSESSION of the condo is 1) House Master, 2) Possessor, 3) Tenant IS responsible for the TM-30

 

The landlord is NOT responsible for the tenants visitors TM-30

Sorry the fine was 1600 not 2000 which according to what I can find out is the fine for not lodging the form in time.

She is not interested in pursuing the issue despite the extenuating circumstances so that is where it lies.
