Immigration police accuse senior officer of filing false charges against them

A group of 48 police officers from the Immigration Bureau on Friday filed a complaint with the new National Police chief, Pol General Torsak Sukwimol, claiming that a senior officer of the Metropolitan Police Bureau (MPB) had falsely accused them of malfeasance and taking bribes.

The bureau's senior officer reportedly accused 48 officers of violating sections 149 and 157 of the Criminal Code by filing a complaint at a police station in Khon Kaen province in the northeastern region.

Section 149 prohibits the accepting of bribes by state officials while Section 157 covers malfeasance in office.

In Thailand, take legal advice before accusing someone, even with incontrovertible evidence of the truth of your allegations. The defamation laws in Thailand are draconian, and the fact that you are telling the truth does not change the fact that the other person suffers reputational damage.

so at least currently the 48 Khon Kaen officer complainants are only objecting to the provenance of the evidence, not that the evidence is bogus.

This is definitely the bulk of the Immigration officials involved in the Tu Hao case who were from Khon Kaen.

 

Big Joke buried this mess with the NACC back in March.

 

This sounds like some officers are trying to fight against the NACC recommending prosecution?

 

At least three have the word general in their titles.

 

Now the immigration offices where the alleged bribes were taken have been named for the first time.

 

They are:

Chiang Mai

Nakhon Ratchasima

Khon Kaen

Sakhon Nakorn

Chaiyaphum

Kalasin

Phrae

Yasothon and Roi-Et.

Taking bribes is like prostitution in Thailand. It does not exist, so it is unfair to blame immigration officers.

Reading between the lines of the two non charged bikers in the murder case, living somewhere whilst having a TM30 and TM47 filed in another place is a deportable offence.

Yes, this might turn ugly for farangs that got their Permission to stay through a Fixer Agent that bribed these Khon Kaen Imm Officers to 'overlook' that the financial requirements were not met.

Note that the complaint of these Imm Officers is NOT that the accusation is untrue, but that the NACC Senior Officer that filed the charges did not officialy report that he did so to his boss, according to procedure.

And in their defence, NACC might well decide to build a stronger case against those Imm Officers, not only by addressing the Tua Hoa Chinese immigrant case that triggered this whole affair, but also zooming in on any other cases of corruption.  Farangs staying in Thailand on an 'illegally acquired Permission to stay from the Khon Kaen Imm Office' might thus become the collateral damage of such a Thai Immigration in-fight.

If this does happen, which is possible but unlikely, the consequences for the farangs will be similar to that faced by those who received the dubious volunteer visas and extensions. They will not face prosecution for what were, at the end of the day, valid extensions. However, their future interactions with Immigration will become more difficult.

Could have been BJ overreaching the law, but he said they were in IDC awaiting deportment and visa offences were given as their "crime".
