Srikcir Posted October 13, 2023 Share Posted October 13, 2023 It looks like the defendant was convicted under TITLE II, OFFENCE RELATING TO PUBLIC ADMINISTRATION - Chapter 2, Malfeasance in Office, Section 154 of the Penal Code: Whoever, being an official having the duty, or professing to have the duty of collecting or checking taxes, duties, fees or any other money, dishonestly collects or fails to collect such taxes, duties, fees or money, or does any act or does not do any act in order that the person having the duty to pay such taxes, duties or fees shall not have to pay them, or pay less than what such person has to pay, shall be punished with imprisonment of five to twenty years, or imprisonment for life and fine of two thousand to forty thousand Baht. (my bold emphasis). This is the only section out of twenty sections in this Chapter that convicted gets more than twenty years, considering fifty years as life. But a literal reading of Section 154 doesn't seem to fit the punishment based solely on inappropriate use of a government vehicle. Unless otherwise the defendant was convicted of violation of multiple sections under this Chapter and imprisonment was cumulative (vs concurrent), ie., two twenty year terms plus one ten year term. The other nineteen sections are very descriptive in the punishment. For example (and maybe more on point): Section 147 Whoever, being an official having the duty of purchasing, manufacturing, managing or keeping any thing, dishonestly misappropriates the same for his own or the other person, or dishonestly allows the other person to misappropriate the same, shall be punished with imprisonment of five to twenty years or imprisonment for life, and fine of two thousand to forty thousand Baht. (my bold emphasis) It's not unheard of that after sentencing in Thailand, that if the defendant then confesses to the crime(s), the court will lower the sentencing time.
