I'd be worried about getting to the airport the next day without my passport and everyone being completely unaware of the situation.

 

"No have passport, cannot. Sorreeee". 

In many years I have been pax on 2 flights cancelled after stamping out of Thailand and leading to another night stay  One this year In both cases there was some delay immigration delay, but no talk of passport confiscation.  Did not make big news but Asiana handled it brilliantly, A serious engine problem.

Thai Immigration Police do not provide a new entrance stamp, They void your exit stamp!

This happened years ago at BKK airport also and in another country. 

 

 If his voiding was on ones last day of Permit to Stay would it not attract on OVERSTAY stamp and fine?

 

 

 

 

 

 

 

The passports were already stamped as leaving , 

One could go thru arrivals again , stamp as arrival , go to hotel,  return and go thru immigration again for the departure stamp. 

Or , leave the passport with the airline  / customs

Obviously all had been processed out of the country when the flight was cancelled. Immigration of any country can hold passports of non citizens within their borders at any time. All these passengers no longer have a permit to be in the country so technically are illegal.  It can be more convienient for the airline to hold the docuents as they basically have control of the passengers.

The alternative would be to process all back in to Thailand, creating protential visa problems for some, and then process out again when the aircraft is available. A  pain for all involved.

No big deal, as a former IO I've dealt with this type of situation several times.

Although, I never had to do paperwork on the floor at an airport.

They would say cooperate with local authorities.

I think you would find The Immigration Act of the country you're in, as well as their courts, will out-trump your country's passport regulations.

I took a flight a few years ago from Bangkok with Etihad.

 

Whislt seated on the plane they discovered a fault and a part had to be delivered and fitted before we could take off. This resulted in our late arrival to Abu Dhabi and many of us missed our connecting flights.

 

We were stamped into to Abu Dhabi but confined to an airport hotel until the morning. We were not free to leave the airport and this was stressed to us. An unusual sticker, with Abu Dhabi on it in English and Arabic was affixed to the back of our passports as well as being stamped in.

 

I remember it well as it was the first time I had seen or used an iris scan.

 

We were treated well, given hotel rooms, breakfast etc and picked up another flight the following morning.

 

We did not however get separated from our passports.

Simple, it´s totally illegal to take a persons passport, without a court order.

Your probably right. I once found myself in a similar spot at Bkk airport,but still at check in. Was put up in a hotel and fed etc but was never asked to hand over passport

In Thailand, who can legally confiscate your passport?

 

Thai Immigration Police or Thai courts if there are grounds for suspected immigration violations.

Same happened to me last Friday with Emirates to London via Dubai. Was downgraded from Business to Economy (technical issue in 1st Class) on the first leg to Dubai AND missed connecting flight, when we landed in Dubai all paperwork was ready and was whisked by chauffeur to a 5* hotel and room for 12 hours, free meals etc in any of the hotel restaurants.

 

I had only booked a ONE WAY flight to UK in Business Class, so was disappointing the 1st leg was downgraded to economy BUT as compensation, they gave me a RETURN Business Class Flight from Bangkok to London to use in next 12 months!

They are good!!

 

I'd be hard pressed to look elsewhere now unless there was a huge price difference.

 

And I love the A380......frequently have an empty seat next to me, so I hope they don't switch back to Boeings at some point in the future.

Wrong, Thai Immigration do, awaiting a court order. Here it was no case!

Thai Immigration does not need a court order to take and hold your passport if it is for an immigration or legal reason.

So, where is the legal reason, because a plane is delayed?

I stopped flying with Qantas quite awhile ago, below par service and food. Spirit of Australia, not any more, more like BS of Australia.

In a case like above it is common practice to hand in yr p.port once you have been stamped out. Or you can stay airside without hotel. 

Of course Thailand could re-enter everybody by cancelling exit stamp but then you spend even more time hanging around before you get to a hotel.

Yes, I went through such a situation in Kuwait.

Because you hadn't been "stamped out" i.e. exited.
