A caddy at a course in Chiang Mai went with a course director to the Mae Ping police yesterday after she was left with blurred vision.

 

She was hit in the eye with a golf ball struck by a foreigner and is now unable to work as a caddy. 

 

MCOT reported that Phairin Kanthawong, 56, is asking for 500,000 baht in compensation.

 

Phairin was armed with a medical certificate that said she had suffered corneal and eye socket damage that led to surgery and blurred vision. 

 

MCOT said that if agreement could not be reached then the case would wind up in court as it was an accident. 

 

Chiang Mai News in English reported that the money had in fact been paid in lieu of the foreigner being taken to court.

Just like having a house next to the course and when an errant ball would break a window, the courses insurance company always would pay.  Guess there is no such thing as workers compensation for injuries sustained here during course of employment, yeah I know TIT....

exactly, unless he was deliberately targeting her or proven negligent there is no case to answer - it was an accident and should be covered by her employer - the golf course

Part of what happens when one is an amateur like myself.  Army Golf, and shanks abound.  I have even hit myself as it struck the cart ahead on the path and ricochet back at me.  I believe that's why we are supposed to yell "Four", and instead of looking up we duck.

This is soooooooo BS ludicrous. It is a golf course for Christ Sakes and she works at the golf course. Sort of like being at a fire dept and getting wet. 

She wants to buy a cadillac and can now see it clearly coming ???? 

It is not a worldwide guarantee that the golfer will not be at fault.

There are some places in the world that if the golfer hits a shot that may be in the line of a person who could be harmed and that golfer does not yell ¨fore¨, then the golfer could be liable.

Also, if the golfer was screwing around, not paying attention and hit an errant or pratice shot out of the normal round of play, they could be liable.

 

In any event, from the last sentence of the above article it appears the golfer or someone already paid out.  So, more then likely he accepted fault for her injuries.

Nonsense nothing to do with the golf course, it is up to the golf player to have his Golf Insurance policy in place for these types of accident

I hope those considering a Thai Elite visa for its golf perks, or the "quality tourists" Thailand really wants, many of whom are likely golfers, do hear about this.

 

I'd better have my golf insurance? Really? I was thinking of hitting the condo pool when I get home. I'd better check up on my swimming insurance. Or maybe the gym, is that equipment really safe? Where's my gym insurance? Good God, those moto taxis! I should be paid up for even looking at them!

Nonsense from you. Golf liability falls under the laws that define sport participation. If the golfer was playing normally and not recklessly straying from game activity, then he has no case to answer to. In the end it comes down to the laws of the particular country.

Back here i came from i had a personal liability insurance. It was the norm in my country.

Rather confusing article.  It implies that she had not been paid, but then said that she has been paid.  I doubt very much the golfer shelled out 500,000 bt...unless he had insurance.  I feel for the woman.  One should not lose an eye at work.  But it was an accident.  I myself have been hit on the forehead by an errant golf ball.  Sht happens.

Yeah, if you're going to tee off with someone in front of you, best make sure it's a slow fivesome, like Koreans. A good whack in the head would be satisfying for these malingerers. I no longer yell "fore" for these guys -- just "incoming!".
