I am having a dispute with a neighbour. He is objecting to my partner smoking on our balcony, saying it permeates into the room, then out of closed doors and windows into a communal area.

He say , along with "do you know who I am" , that smoking in a condominium room is illegal and next time he will call the police (because of who he is). 

Is smoking inside a condo illegal?

    I would agree with him.........smoking in a condo anywhere is a fire hazard.....even ignoring the fact that I would also strongly object to breathing in someones second hand smoke.

    How in God's name do people think it is acceptable to smoke knowing the smoke can drift into someone else's apartment.......laws or no laws it is totally unacceptable.

    Unless the Juristic Person has said that it is, it's probably not but it sounds as though, regardless of your partner's smoke getting to his condo from your balcony, you just want to ignore him anyway

wouldn't that depend on the condo rules in place? btw being a non smoker I don't like the smell wafting over to my balcony. In the past I've lit handfuls of incense to counter it lol..

Unless the Juristic Person has said that it is, it's probably not but it sounds as though, regardless of your partner's smoke getting to his condo from your balcony, you just want to ignore him anyway.   

 

Why not ask your partner to show some consideration for your neighbours by not smoking there?   That would be nice and neighbourly, don't you think?

 

Your thread title is "Smoking in room", that probably wouldn't be a problem but your partner is smoking on the balcony, not in the room.   Why is that, do you not like the smell of her fag smoke in your room, either?   Just like your neighbours don't like it in their room?

If my neighbors in the condominium next door make too much noise at night then I call the security and/or I inform the management of the building. I don't call the police, that's not their job.

I guess the same applies to smoking. If, and this is a big if, smoking on the balcony is illegal then he should first speak to you and then to the management, not to the police.

I'd tell him to take it up with your partner.

Why get involved when he isn't complaining about you?

Thailand passed a law making it illegal to smoke in your home, there is no law about smoking outside on the balcony.

 

Where did it say the partner was female, or the OP was male for that matter?

Legal or not, I don't know,

But if I had a choice of living  next door to your partner, or your neighbour, I'd pick the neighbour every time.

Where does it say that they aren't but what does it matter what I assumed?   I was addressing the smoking problem, not the sex of those involved.

Thanks, that's the  info I was after.

Don't be so sure that it's correct in its application to your situation.  Smoking in condos is illegal, apparently.

Only playing devil's advocate.......apartments aren't public spaces......so balconies might not be covered by that!!!

If your partner is smoking too frequent then this is a problem, but you might want to ask your partner to do it later at night. Or you could just tell you neighbor to close their balcony door or window when they smell the smoke because it is not their place or a common shared place. I can see both points. Electronic cigs you can't even smell.  .

Not always true. They have fruity flavors they add to the vape liquid so it smells like a fruit, gum or whatever.  However, it is not as disgusting as cigarette smoke wafting into your house through an open door.

Tell him to close his windows/doors. Unless it's a condo regulation, your partner can smoke on your balcony. He could be more considerate and move if he doesn't like it.

The responsible party is the  owner or leaseholder of the unit. It is the leaseholder or owner who is required to follow condo rules and  who is responsible for conduct of guests.

 

Must be a very heavy smoker and/or the condominium is poorly built if smoke seeps in so easily.  A balcony fan may help. Can't be much fun living so close to someone  who smells like ashtray and has the bad skin, breath and teeth that goes with it.

 

Our condo does (among other things) not allow smoking on balcony or common areas and implies fines for each reported case. They also impose fines for not wearing mask in common area.

 

They are all listed in the house rules in their Home app. Along with fines.

 

All they collect is donated to Red Cross though.

With all the psycho's running around Thailand, why would you risk making trouble for yourself?

 

He probably has a lot more friends than you.

Well that's easy to answer. The balcony square footage (meterage?) is included in the size of the condo, therefore it is part of the condo. No smoking there obviously.

They should ban eating durian in the condos or on balconies

This could potentially be applied:

Here at my condo they put up up a bunch of signs saying no smoking in the condo, on the balcony, or common areas, besides of in designated smoking areas.

It's by the way absolutely possible that the smell from the balcony enters his condo, so be considerate and tell your partner to stop smoking, whatever any laws or rules say.
