Landlord Breaking Contract after 2 months to put rent up 20,000 baht!!

Hello guys

 

I'm in a really frustrating situation with my landlord.  We've been in this place since 1st September, with a contract for 6 months that also includes a promise for renewal of another 6 months if we wanted.  So effectively 12 months.

 

The owner is a French guy who I've never met and I've been dealing with his Thai agents.  2 days ago I get an ominous message about the agent coming to see me about the contract.  I ask him if its anything to worry about and he says no not really, just need to talk about something.

 

The agent gets here and takes a deep breath - and proceeds to tell me what is happening and what the owner is planning on doing.  That the owner wants to break our contract and needs me to leave within 2 months.  The agent gives me a bit more info then he maybe should of and I respect him for that as he is a genuinely nice guy.  He tells me that the reason for breaking the contract is so that he can put the price up another 20,000 baht but what we will be told is that the villa has been sold.  The agent says that he has a get out in the contract relating to if the villa is sold.  The contract does not mention anything like this anywhere.

 

And as well as that we know that the villa hasn't been sold and is already being advertised at the higher rate on Facebook etc- BY THE SAME FRENCH OWNER NO LESS!!!!  No ones ever even give us a chance to pay more (I wouldn't). - all we've been given is the ultimatum to leave.

 

Now I know this is Thailand and money talks and the owner has probably got a louder voice than me - and there probably isn't much I can do.  But I would like to know where I stand with this so I can consider what to do.  Its a completely dodgy situation full of lies and deceit and I hate getting f@^&ed over like this.

 

Any advice would be very much appreciated - even if its just "tuck your tail and leave"

Two things you can do really. Stand your ground and refuse to leave till the contract is over or leave.

I think we will see more of this as people slowly start to return now and the market will, theoretically have e more money in it.

 

I would just say no and let them think you are nor moving. All the time looking for an alternative if you feel uncomfortable. If I had a tenant for a year and was trying to sell I would be prepared to make the tenant am "offer" to move out in order to make more selling it tenant free.

People are for ever complaining about being scammed, contracts not being honored, laws and rules not being complied with or being enforced........as one member on this forum said......just get on with it....."it is how we roll in Thailand".

But I am on the side of get out and get another place. I am sure there are landlords out there who are honest to deal with.

Tel him you respect the contract and stay, no need to run like a mouse as others would do. You DO have rights in Thailand.

Why would he leave? If the landlord wants out of the contract he can pay the guy or wait till the 6 months is over. 

Just refuse to move out until house is sold (which it won't).

What a greedy schmuck this French guy is.  A man of no honor.  I'd recommend speaking to the guy face-to-face, but I'll bet he's also a coward who wouldn't want to confront someone he just screwed.  Not much you can do as taking the legal path may cost you more and result in more headaches.  Look on the bright side.  At least you're getting 2 months to look for a new place.  You might even do better, so just take the high road. 

Leave in 2 months. But don't pay for the electricity and water that you will use during these 2 months. (Not applicable if there is a deposit involved).

I saw something similar happen last April (not me) where the landlord wanted them out, I dont know the full details but this tenant did move out, from what I can see the future deal the landlord thought he had fell through the property has been empty ever since

SamuiAddict  ........     take this advice ....         ( you've been given 2 months notice which is pretty good ) it's not like a week.

 

do you want hassle and grief ......   ?

do you want to get mixed up in a stressful situation which likely will amount to the owner winning .... ?

do you want to cause friction and have some Thai thug cause problem in a bar or whatever later ...  ?

 

because I can tell you that even though you may well be within your rights and bla ... bla ... bla .....  

TIT .... it's not Australia or the UK ,     

just move on,  find another nice place and go from their ,   why give yourself a big problem because that's what will happen if you start trying the Lawyer act .........

You been there 2 month.  He is "giving" you another 2 months.  Move on and call it a day.

 

There is nothing worse than staying in a toxic relationship, be it romantic, employment or renting.  The stress over time will not be worth the benefit of standing your ground few more months.  In the end you gotta move anyway, it is not a permanent home.....

You don't need a lawyer, you just don't move out and wait what he will do.

Fine, just find another place and not pay another baht in rent just use your deposit as rent. The amount of money he will lose in an empty property waiting for a new tenant  - if he does not have one - will far exceed the money he thinks he can get from breaking his contract.

Your actual contract is 6 months and you are told to leave once that expires right, so whatever you discussed informally to extend later isn’t relevant.

 

I had the same in past as the landlord thought Thailand would reopen already, she learnt the hard way as property sits empty since.

I believe the landlord can ask you to leave if he has sold the property or wishes to move in to the dwelling him self .

Asking for an increase of rent within the rental agreement is not possible .

I would consider taking the owner to a civil court for enforcing the contract .
