Both granted today, exactly 9month 2 days....

I wanted to share this review by the MRT where a guy living in OZ got knocked back on his Partner application even though he was married to her. It goes to show DIAC can have a mind of their own somedays, and it also places emphasis on what evidence you should submit. The bottom highlights the criteria set out of the regulations in terms of what they look for.

Note- the decision was for it to be sent back to bangkok for more assessment as he met the criteria.

Poor bloke. A friking longer wait then our 9 months.

Interesting.

Looks like the guy didn't submit enough evidence the first time around.

these were just the additional documents before the review the applicant supplied:

  1. Prior to the hearing the review applicant filed several additional documents as follows:
    • Documents demonstrating that the applicants have a joint bank account in displeft.png Thailand dispright.png.
    • Superannuation document demonstrating that the visa applicant is the sole beneficiary of the review applicant’s superannuation and life insurance policies.
    • Various receipts for the applicants’ hotel accommodation in displeft.png Thailand dispright.png.
    • Prepaid currency card statements, in the review applicant’s name, demonstrating deposits and withdrawals in displeft.png Thailand dispright.png for the period 4 June 2011 – 28 March 2013.
    • Several photographs covering the periods January, March 2011, May 2012, December 2012, January, February and March 2013 showing the applicants’ in wedding attire and socialising with family and friends, attending a Buddhist temple and engaging in other social activities together.
    • Over 400 pages of telephone accounts demonstrating lengthy daily phone calls and text messages between the applicants for the period January 2011 to June 2013.
    • Correspondence from family members further attesting to the genuine relationship between the couple.

That's another thing not always taken into account.

People can submit extra information at an appeal that they didn't submit

in the original application.

DIAC can only assess what is given to them the first time.

I will let you know how things going later. At the moment just planning for best options. If I understood everything correctly: could a person get tourist / visitor visa during the time of waiting for temporary resident visa for his wife?

If yes, is it OK to be waiting anywhere as Bali or any other country?

Not sure the visa you have applied for. But my fiancé is on her second tourist visa while we're waiting for her Fiancé visa here in Aus. The plan is if we get it while she's here just do a quick trip out to Bali as she has to be out of Aus to be granted ...

They contacted us but this may be because we had been in regular communication with our CO all along.

She has been really helpful actually, she has been telling us every 3 weeks where in the final queue the decision mazkers is making approvals for etc. Seems like they are going in order of lodgment dates and are at the start of december 2013 for current approvals.. there are 2 exceptions.. One is if people go in the final queue very fast they seem to get the visa bit early.. The other exception is Ribbit.. His application defies their normal pattern for decisions.

I have to say it is extremely frustrating about how long it has taken.

We did email the CO and all we got in return was a generic email saying it was within standard processing times. That was early this week.

The frustrating part is there has been no contact from the embassy since Feb, Before then they were great at replying to us and helpful. But now its just gone quiet, this is the part that is making me nervous.

I am reading about other visas that have been granted and starting to question if we have done anything wrong. I know that we havent and there is no reason for refusal, but cant help thinking and thinking stupid things

Wow" you were in contact with your CO every 3 weeks !!!

I have just hit 7 months and have had nothing...

Not one update. Only cos I have been told to sit tight and wait and if they don't call you it's a good sign, but can't do it no more I'm going to email them today for the first time.

Just would love to know if I'm in the final queue stage.

Yes a agent here in Australia they keep on telling me it's a good thing we have had no contact from them. I wanted my agent to contact them last month but she said no to early . But I'm pushing my agent to ask for a update today as 7 months has passed!!!

That's because if you use an agent, the CO should be going through them, not you.

That's what you pay the agent for.

I know the wait can be frustrating, but really there's nothing much you can do apart from wait.

Like krisb said on another post "just take a deep breath and wait".

That's because if you use an agent, the CO should be going through them, not you.

That's what you pay the agent for.

I know the wait can be frustrating, but really there's nothing much you can do apart from wait.

I understand that but even the agent is not hearing anything from them.

We email and only get automatic response.

The CO will usually only contact the agent if they need something

or to provide a grant date.

Not hearing anything can often be seen as a good thing.

That is a good question, With out going in to details I think that could be the case with me. My partner has a child from previous relationship.

Ex-partner has signed all documents allowing the child to leave. This was provided to the embassy when the application was lodged

This is the only thing I can think of that could be holding it up.

I called my agent today and she's sending a email in for a update. This is our first ask for a update, will be interesting what they will say after 7 months of nothing from them.

It seems some case officers are a lot better than others.Some keep in touch and tell you where you are at and others dont contact you at all . It's just a lottery who you get.

Are the 'children' ... Thai Citizens only or Dual Citizens?

We waited for MissFarmGirl's Partner Visa application till after our children were granted Citizen by Descent by the OZ Embassy as it strengthens the perceived bond between us.

If the children are your partners ... then the answer might be different.

Just a thought bubble ... I have no experience in this area ... same as all of us.

This visa has really got to me today !!

My agent sent a email 2 weeks ago for a update as we have hit over the 7th month mark and no replie yet. My agent keeps on telling me there really busy ..

I think it's redicules that it takes so long. If they got or the info there in front of them how can it take so long, I understand if we are boat people but please wats the threat.!!
