‘Joe Ferrari’, six other ex-cops deny charge of torturing suspect to death

Dismissed former superintendent of Thailand’s Nakhon Sawan police, Thitisan “Joe Ferrari” Uttanaphon, admitted in court today (Friday) that he assaulted suspect, Jirapong Thanapat, to extract information about the illicit drug trade, but denied the charge of torturing him to death, saying he did not mean to kill him.

 

Thitisan and his six former subordinates appeared before the Central Criminal Court for Corruption and Misconduct Cases in the first hearing of a case in which the seven are accused of using several layers of plastic bags to cover the head of Jirapong, during interrogation in police custody in August 5th. The victim died of suffocation.

 

All seven men, including Thitisan, were indicted on four charges, including murder by means of torture, which carries the death penalty. Some of the group admitted to some charges, while others denied all charges. None in the group confessed to the charge of murder.

It's almost certain that he didn't mean to kill the 24 yr old; there would be easier ways to do that, and they were really interested in getting him to lead them to the money, or just cough it up-that he died that way is almost worse, I'm no lawyer but that seems way beyond negligent homicide or manslaughter.

I'm also interested in the others, if any of them will find a way to reduce the charges substantially.

Right, so if you are torturing someone and they 'accidentally die' in the process they should get a lesser sentence or be charged with less, even less than manslaughter ? If you are not willing to accept the person you are torturing may die - don't do it !

Maybe I didn't express myself clearly, but my view is the same as yours, that this seems far worse than manslaughter and imo should be considered worse than simple murder, premeditated or not.

I have never watched someone suffocating but I imagine that there would be great a struggle and resistance which would become less and less as the person is dying . For sure the police were pushing this man to the limit hoping to  extract a confession . They didn't want him to die before the confession was given . I don't think it was premeditated but the end result was the same . I'm waiting for an reinactment of the crime with Joe in the hot seat

Using one bag, may have been believable that death was accidental, using more than 5

is a guarantee that this 24 year old guy was going to die. The video is a good thing to

have and use in court against this very rich, ex cop, and his close friends who were in the same room

and did not lift a finger to help this 24 year old guy.

  But this is Thailand. so we all get to watch the proceedings and see if there is any justice in the country.

I can’t help but think about the poor soul who had every breath squeezed out of his body the torture and suffering must have been unbearable as far as I am concerned everybody in that room is either guilty of murder or an accomplice to murder as no one apparently tried to stop what was happening I expect all of them to be found guilty and receive the death sentence .

In UK and US law an essential difference between murder and manslaughter is murder must be carried out “with malice aforethought, either express or implied” which translates as an intention to kill or cause really serious bodily harm. If the prosecution can prove that the acts committed were intended at minimum to cause really serious bodily harm, then it will be murder. Otherwise it can only be manslaughter at most. So putting one bag on a victim’s head for short periods resulting in death might be manslaughter, whereas several bags and tape being used is good evidence of intent from the point of view that such actions  showed at least recklessness for the welfare of the victim. 
 

It is difficult to prove what is in the mind of the killers, called mens rea, and depends on skillful interview and evidence gathered before and after the fact.

 

i also don’t know to what extent Thai law follows these principles.

What would a common sense person think? Six plastic bags would say I am out to kill you. A smack around the face or in the stomach is assault.

I'm amazed the er cops haven't been dealt with. Better this just goes away, slipped on the soap or faulty power switch etc.

So the obvious answer is they are going to get off, suspended sentence for time served and no justice whatsoever. TIT

Well, guess what. The poor fellow got suicided, all was an honest mistake and the whole lot of the police slime is being reposted to the Ministry of Inactive Posts for a while. In a year or two, back to work with a full re-instatement, backpayment of salaries and a promotion for all of them. Seen it before, will not change this time - unless of course the little Ferrari pr1ck does not fill the little brown manila envelopes with some of his illicit dew .......

Um, the video shows exactly what happened, e.g. at no time did he remove the plastic bags over the victims head to allow him to breath, now that to me is murder, not torture as he claims it to be, end of story.

 

It is no different to holding a block down while your mate constantly beats the <deleted> out of him till his last breath, i.e. you did nothing to say, hey ok, enough and then stop him, let's not forget the extortion bit.

 

Its even worse when it's cops standing by and then they deliberately try to cover it up by taking the deceased to hospital saying he overdosed on drugs and then threatened his girlfriend/wife to keep her mouth shut, then gave the family money to keep quiet.

 

You know the guys that are supposed to uphold the law, fricken idiots !

 

I hope you all get the death penalty with plastic bags being put over your heads till your last breath.

in the "war on drugs" it' hard to tell who is more dangerous, the perps or the enforcers.

after decades of failure perhaps the authorities might consider what a pointless "war" it is.

I disagree, this made world headlines, and the fact that they are now ex-cops means the chopping bloke is coming down on at least Joe, the rest might get life and or long sentences ranging from 15-25 years to appease the public. Then the honchos higher up can split the assets/money Joe had on top of what the honchos gave them to not be put to death.

Exactly. It would be a 'game over' revelation if the audio to this particularly disgusting crime had been recorded and made available to the public. I wonder how many times the victim was told he would die if he didn't talk?

This is not just about drugs. This is about how Police get there confessions know matter what the offence.

The man recording the proceedings could be implicated as he done nothing either .

Hot tip Joe Hotrod, putting plastic bags over a suspects head, and recorded doing it, means you tortured the suspect,  and you killed him.  No way you will be allowed to get away with this while the world watches to see  The world is watching,  potential  tourist are watching  and if a police officer can get away with this when their job should be to protect then what message does it send to the world.  If you get away with this others will follow.  Is this what anyone wants for a counyry?

It’s irrelevant now whether he meant to kill him or not. He abused his position (and probably for many years judging from his wealth), tortured the victim, and murdered him. Oh, and it’s on video. The evidence against him is overwhelming. He’s obviously guilty of manslaughter. The only question is should they charge him with murder, which incidentally he should.
