Thai Rath reported on a judgment handed down by the Thonburi Criminal Court yesterday against a Police Hospital doctor who killed two people and seriously injured a third after he drove his red plate (brand new) Porsche Cayenne into the back of a Honda Civic on Ratchapreuk Road, Phasi Charoen, at 5 am on August 29th last year.

 

The accident happened by the Bang wa BTS.

 

The court handed down a 6 year sentence and a 202,000 baht fine.

 

This was all reduced by half on admission and the prison sentence was suspended for 2 years.

 

 

A fine of 1,000 baht was levied for driving a red plate vehicle after sunset.

 

The defendant - Pol Capt Phanurak Rattanaphaisorn - was also ordered to pay 5.5 million in compensation to the families of the deceased and the injured party.

 

He was given 30 hours community service and has to do three probation visits. 

 

The court heard how the Porsche was speeding in the DUI and negligence case. 

 

Twenty nine year old Pornyamon and Chakkrit Siri-Isaranan, 75, died. The driver of the Civic, Pongpetch Siri-Isaranan, 44, was grievously injured.

 

Kanpong Siri-Isaranan, son of one of the victims, announced the family's intention to appeal the sentence for a longer jail term and no suspension. He said that the defendant had shown no remorse and his apologies were not genuine.

 

Pongpetch said that a year and more after the accident and she still can't walk properly. There was no justice in her view.

 

She called on the Thai justice system to get more serious about DUI like in many countries abroad.

Wouldn't this be called Vehicular Manslaughter? Should get jail time and banned for life, but in Thailand he has money and influence, so we'll let him off?

I wonder when he was arrested at the scene of the crime whether or not the coppers used the steel monkey rods to incapacitate him or whether he was chauffeured to the station in a limo equipped with a tv and a fridge full of champers.

DUI , Killing 2 people , seriously injuring a 3 rd , gets what amounts to

a slap on the wrist , disgusting ,no really disgusting , they are not

really serious about stopping or reducing DUI here in Thailand ,

been rich and influential I am sure resulted in the sentence , there

has always been two sets of laws in Thailand , them and us......

I will probably get a few negatives on this one but here is another point of view.

The Thai justice system being what it is,it is not the same wherever you

are from,

He already paid the family and that goes a long way here in Thailand.

Ok, i agree the sentence should have jail time but he got off easy.

On the other hand,putting a doctor in jail while there is a shortage of doctors will not do any one any good.

As far as justice (the Thai way) goes,the family did receive justice.

But putting a Doctor in jail is absolutely required in this case.. otherwise I guarantee he will re-offend with drunk driving..

Those with the gold make the rules.

 

(True in all countries.

Even so, many countries treat vehicular manslaughter/DUI seriously but not here).

Its not just about justice....  its about ‘sending the message’ that this behaviour is unacceptable and will be punished.

 

This is where the Thai legal system fails - the flaws and in-balance in the system simply enable people to continue on with flagrant disregard for the laws because they know they can get away with it.... 

 

Its that simple... Ask anyone who drink-drives here in Thailand if they would dare do the same in the UK, Japan or Middle East etc and we’d receive an emphatic ‘No !!!’... 

 

..... So, why do those very same people do so [drink and drive] in Thailand ?????

You may well have an "information-advantage" over me.

 

  -  You wrote that Pol Capt Phanurak Rattanaphaisorn had *already* paid the Family/Families.

I searched on the Internet, but I could not see a news-story that reported that the money had *already* been paid.

From the OP above, I read that The Court has *ordered* him to pay 5.5m Baht to the Families.

I am sure the sentence would've been much harsher if the defendant did not drive a Porsche and does not have a 'Pol Capt' prefix to his name. Life is cheap here, and that's to their own kind! The dirty falangs and foreigners don't stand a chance! Be extra vigilant when out and about here, and pray that the light at the end of the tunnel isn't a runaway freight train coming your way at full speed.

Punishment of a police officer or doctor, persons in a position of responsibility and trust, should be more severe, not less.

 

The police officer who ran down the doctor on a pedestrian crossing whilst unlicensed and riding a high powered motorcycle, and now this police officer and doctor, degrade the reputation of the Royal Thai Police. To counter this, it’s time to alter the attitude both of the police management and the public. 
 

This is firmly the responsibility of the Government. How about it?

The driving offence was committed by a male person. That is sufficient informatin.  2 people sadly died and another critically injured.The male driver was speeding and drunk! That's all the police, courts etc need to know .He should have been sentenced accordingly, and indeed everyone should know that under similar circumstances they would receive the same punishment.

 

Doctor, rich man, politician, or someone even higher should be irrelevant!  One crime the same punishment!

No surprise here for me amazing Thailand TIT

The problem now - or would be in another countries - is that it sets a new bar for sentences, anybody can now quote this case when sentencing and appeal if if is harsher.

 

I hope the family sue the doctor through the courts and get half the assets and 25% of the wages for LIFE

I have always said, punishment for a police officer or an army officer should be more severe, not less. And does anyone wonder why we don't take the courts, the cops and the entire judiciary seriously? It is so bent, it boggles the mind. 

Same what will happen too the soldier guy who killed two and badly injured the daughter, he already admitted everything because he knows his sentence will be reduced and he’ll probably get a suspended sentence.

Unfortunately that holds true for most developed countries as well. USA loves to keep spewing that no one is above the law as they prove on a regular basis that, that is a total load of BS. 

 

The average citizen that commits a crime usually only affects one person or a few people (or in the case of simple possession of drugs there is no real victim), they are swiftly convicted to the fullest extent of the law and locked up. The criminal elites crimes often affect millions of people, cause massive damage for years, but these criminals often either evade charges or in the rare cases when they are convicted get sent to a cushy federal prison with a tennis court and even then receive an almost immediate release because they might get Covid or have some other bogus health issue that no common person would ever be released for.

 

There is no justice for the rich and powerful, full stop.

Add politicians to that list as well. They abuse the public trust they should be punished extra for that.

You have a point about compensation. Someone in our village killed a kid who was taking an apple from his tree, and he simply paid off the parents, left the village for a few months and is now back as if nothing happened. The police didn't even get involved as far as I know, although they might have negotiated to get their cut.

The way we do things in the west, the family would have got nothing.
