Petition submitted against Thaksin seeking Royal pardon

The Thai Pakdee party submitted a petition to Corrections Department director general on Monday, opposing any attempt by former prime minister Thaksin Shinawatra to seek a Royal pardon.

 

The party’s move was triggered by widespread reports that Thaksin, who is serving eight years in prison and who is currently being treated at the Police General Hospital in Bangkok, may seek a pardon.

 

Anand Sakorncharoen, treasurer of Thai Pakdee, said that, the petition is based on the fact that former prime minister Thaksin has been convicted of corruption in four cases, which gravely damaged the country’s governance and reputation.

 

“Thaksin also evaded punishment for long time by fleeing abroad, clearly showing that he does not respect the country’s justice system. “Therefore, Thaksin’s petition for a Royal pardon would “bother” the King,” Anand said.

 

Thaksin’s petition, if granted, would be unjust and emphasise legal and social inequality in the country, he said, and would confirm the axiom that, in Thailand, prison is just for the poor.

I think anyone who's spent even the slightest amount of time here and witnessed the Machiavellian skullduggery of Thai politics would struggle to imagine that at all !!...

Ok, I admit this is not exactly likely. But it's a wonderful thought.

And let's not forget that he has powerful friends. But he also has powerful enemies. Thinks can go wrong.

Section 112 springs to mind.

They are not petitioning the King. They are petitioning the corrections department to not forward a request for a royal pardon if one came along. To decide which requests to forward is part of the official role of the corrections department.

But that's not at all the case. There are many possible requests for the Kings consent, pardons are just one of them. But in pretty much all cases there are lower parts of the system which are supposed to filter those requests before they reach the King. Otherwise there'd probably be an insurmountable amount of requests to consider. Similarily how you have to go through several layers of courts before being able to appeal a case to the Supreme Court. That doesn't mean a lower court gets to decide for the Supreme Court.

Khun Thaksin - 15yrs in exile for some dodging dealings.... no statute of limitation must do 8yrs in jail.

He already has a deal set up..

do you think for a split second he's come back to serve time in jail?

He returned to Thailand looking resplendent and at ease in a private jet, got chauffeured to the court house, spent less than half a day in jail, then rushed to hospital?

It's all a well rehearsed game where step by step he will get freedom.

To demonstrate to the common folk that the law is applied equally to all, Thaksin needs to serve his 8 years. 

Ok, let him out in 2 or 3 years if good behaviour. That includes NOT meddling in politics.

It is the money that opens all doors.. and Thaksin has a lot of it... Shameful that everybody pretends he is treated as other inmates, but in 15 years exile he was never in hospital or nobody has heard he was sick, and suddenly in Thailand he gets sick. Besides there is a violation of section 112 but  he can seek for a Royal pardon.. How many protestor are being falsely accused of section 112 and did not get a pardon at all.. or even the hunger strikers last year.. they were ignored by the media and nobody could comment.. and a criminal can get what he want???? Shameful Thailand

I don't think he has a deal.

He might have convinced many people to do this and that and he thought that he covered 100% of his way out of prison. And maybe he will come out soon.

But sometimes you think you have to think about 100 things, but in reality you had to think about 101 things. And then at some time you find out that little thing, which you didn't think about, makes your life difficult. That could happen. I guess it is not likely, but it's not impossible that he will stay a little longer in jail.

I'm pretty sure that if Thaksin is to get a pardon, that decision will have already been made. Even if it hasn't, he will know which channels to use to make sure his own petition gets to the king - and in the light of this news, he certainly won't be going through the corrections department.

Not required in Thailand. One can directly petition the Constitutional Court without "layers of courts." Or indirectly through agencies that have standing with the CC such as the Election Commission or Ombudsman.

Otherwise processing Thaksin's probable petition starts with the prison director.

No, it was a royal endorsement. No "coup folk" (NCPO) were ever convicted that would require a pardon and in fact the Constitutional Court later recognized all coup orders as legal.

Really? You don't think that Pheu Thai reneging on their election promises (reforms) had anything to do with it? Interestingly, when they did that, they gained the support of Prayuth's party (United Thai Nation) in the forthcoming coalition.  Prayuth joining forces with the Shinawatra family - well I never....................

 

However, I don't think he will be freed in the immediate future - that would really be taking the P.  In my opinion the hospital thing has simply been so that he doesn't have to spend any time in an actual jail. I think they'll have to leave him there, or somewhere similar for a while.

 

However, I suppose its possible that he will ask for clemency on the grounds of ill health - the hospitalisation would fit with that too.

Trumped up? That's a very appropriate but unfounded description considering the popularity of it in certain parts of the world.
