Thanks for the link. Nothing in writing regarding the tax exemption on income earned abroad in the same year it is remitted. At the moment, we only have a verbal statement from one RD official, Mr. Kasapon Singprasert. Other officials may have differing interpretations. Hopefully, we’ll soon see a newly issued Royal Decree or Ministerial Directive, as Oldcpu recently mentioned in a post, that clearly addresses this issue, and possibly more, for everyone to count on.

Having worked on legal issues for most of my career, my opinion is the slides provide the legal support we need.  Slides 4 and 7 provide a broad “Exemption of Personal Income Tax on foreign-sourced income” for 3 categories of LTR visa holders.  If there were any exceptions to this broad exemption, for example foreign-sourced income remitted to Thailand in the same year it was earned, then those exceptions must be included in the slides for them to be valid legally.  Also, trying to tax our foreign income in any way contradicts the objective of the visa as noted on slide 2.  If anyone is still uncertain about this issue, it looks like you can schedule an appointment with RD to discuss the matter.

Fair point. In slides 4 and 7, there is no note linking the statement "Exemption of Personal Income Tax on foreign-sourced income" to RD743. Therefore, this should be interpreted as a standalone statement of complete exemption, regardless of other factors.

Unless that work was Thailand based I don't think your opinion will reflect actual practice. All it will take is for an RD director to say something different from this Senior Tax Economist and everything could flip again. TIT.

There's always the chance that someone in a branch office doesn't agree with -- or has never heard of -- the party line. Nevertheless, these BoI slides certainly give you the credence to not file a tax return, and not go out and get a TIN -- and not worry about being audited.

TIT but if they flip the script on us, then many of us who signed up for the LTR visa based on the promise of a tax exemption will say goodbye to Thailand or spend <180 days here, negatively impacting their stated objective of attracting high-spending foreigners to stay in Thailand.  It’s not just RD at play here.  BOI has some political power here and it’s why this special visa is administered by them and not immigration.  If this does change, then they will not be able to collect back taxes from people who were misled about their tax exemption. 

The important issue is that the English translation of any Thai rules and regulations are simply guidance and if not useless, only the original Thai script rules count in any dispute, having just gone through an issue(not the LTR) turns out the english version was nonsense, the Thai version actually helped me, so it is going to depend on any Thai dealing with the next 5 year of the visa, as it will be up to them to decide what the written rules requires, i have no doubt that there will be variations, trying to quote an english print out will be simply brushed aside.

He doesn’t like this visa and never (as far as i recall ) had a positive word to say about it.

From what he says, I just presume he was unable to attend the BOI LTR community update recently , as many of the concerns/objections he raises were dealt with during that meeting ( including by a senior representative from the Thai Revenue Department) and also at the follow on sessions after the main meeting .

These involved one on one consultations with BOI officers.

Personally I did attend all of this and reported feedback above.

I know TIT and things can change but, as of right now, he seems not to be a reliable or unbiased source on this subject.

has been around for a couple of years now...not as many obtain it before as it was 100K then two years ago they dropped it to 50K...foreign income tax exempt, no 90-day reports, out and back into country with no need for additional permit to re-enter. If one meets any of the 4 criteria, it can be a great visa, IMHO perfect for me.

I agree, there might be a need for higher income for the wealthy retiree but IAW all I have seen and heard is that the 5-year is going to insure that the holder of that visa has met and still meets the criteria for the original issue which is basically the same for any visa when you need to extend it for another period. I personally like this visa.

He has made a big deal about his Thai Citizenship in the past.

I don't know if he got it via the PR route, but maybe he is just peed off that some people have been able to obtain , what is effectively PR, at least for 10 years, without jumping through all the hoops that he had to go through.

And even more annoyingly these LTR holders enjoy tax privileges not available to Thai Citizens or holders of Thai PR status.

The LTR Visa has been 50K from day one Sep 2022. Now in mid 2022 before the LTR program actually kicked off the govt was talking maybe Bt100K for the LTR visa but when the program actually kicked off in Sep 2022 the fee was Bt50Kas it still is now..

Yeah when I first heard about it on this forum they mentioned 100K, I don't remember the exact wording, only that after that I began reading how few people were even thinking of getting it then I saw it had changed to 50K so immediately contacted BOI and a couple of weeks later I now set...as I am approaching 80 years of age this year, likely won't need to extend but then who knows....I just like the depart and return with no problems, once a year notify address, no taxes on foreign income. Immigration folks have always treated me but just didn't like the wait in the AM but that had improved after a few years too but then began to be lots of folks waiting. Best one for me!
