Daily News Thai Caption: Appealing for a lawyer's help

 

A lady who sells chicken's eggs who was hit by a Lamborghini has gone to a lawyer with CCTV evidence that shows a driver switch.

 

After an accident that overturned the lady's pick-up the footage showed that the driver of the luxury supercar was switched from a foreigner to a Thai who had been in the passenger seat. 

 

Now a lawyer is going to the Muang Phetchaburi police with the damning evidence that could see the foreigner in deep trouble, possibly facing prison.

 

Kamlaithong Seesaengjan, 33, had picked up a load of 1,385 trays of eggs from a farm at a cost of 190,000 baht and was heading for a customer in Trang, southern Thailand.

 

She was involved in a collision with a blue Lamborghini with a red (new car) plate of ก9999 Bangkok. 

 

It happened on the southbound side of the Petchkasem Highway at 5 am on September 10th.

 

The Thai lady's vehicle overturned and was damaged and all her cargo was destroyed. It happened in Muang Phetchaburi.

She was taken to hospital in Phetchaburi and given 6,000 for her injuries.

 

Another car was also involved in the accident though the driver was not injured.

 

It was decided that Apiwat, who was on police documents as the driver of the Lamborghini, would pay 100,000 baht for the loss of the eggs up front.

 

This didn't compensate the lady fully and she was concerned that she'd have to return this when the insurance claim came through, reported Daily News.

 

She contacted Apiwat who said that the insurance company would sort everything out.

Then it emerged from the driver of the other vehicle that a foreigner in a green shirt had got out of the driver's seat and a Thai who was wearing black had been in the passenger seat following the accident.

 

A lawyer called Pongprit Sutthikoon, representing Decha of "Thanai Khlai Thuk", will now take the evidence to the Muang Petchaburi police.

 

If it can be proven that the foreigner was behind the wheel he and the Thai will be in far more trouble than just from the original accident.

 

This involves the falsification of documents that would carry a jail term, suggests ASEAN NOW. 

 

More on this as we hear of it.

OR ... it's the Thai's car, and insurance doesn't cover other drivers.

This, while possible, would not be the norm in Thailand where insurance usually covers the vehicle, without respect to who is driving it.

Consider the damage on the Lambo, it looks like a sideswipe to me. So the D-max has crossed into the path of the Lambo? No video footage for that? Furthermore, these racing tires on the pickup aren't original as well as the carry box. So, if the guy has the money for a Lambo it should be no problem to get a good lawyer and he comes out scot free and the egg's seller pays the bill.

The obvious assumption is that the foreigner had been drinking....    

Or, as another poster mention, perhaps the insurance only covered the ‘other person’....  (quite possible that insurance on a super-car is named driver only)...

As you mentioned - its quite possible that the Lambo was approaching at speed, the pickup (with eggs) changed lanes without looking or simply thought the approaching Lambo was too for off... 

 

There is no mentioned of how the accident happened though. 

 

But, as fare as the article is concerned, its beside the point: the driver of the Lambo swapped, and both the driver and passenger could be facing serious charges.

He just has to find another witness to say that he had swapped prior to the lady seeing him swap  the second time. It might cost him a few baht but it's worth a try Right?

This concern is coming from the lawyer of the egg's lady. So far no statement from the police or if alcohol was involved. 

 

Questionable should also be the load of the pickup. With 2100kg of eggs the payload of the D-max is way too much exceeded.

Easy for a good lawyer to catch on that. 

Also they didn't make a runner and the driver's swap can be excused of fear of the two tier standard in Thailand.

Only reason would be uninsured. Because if call insurance company agent in location right away all can be forgotten whit money. No police needed. But maybe this farang dont know how things go in here. Should know if drive that kind car.

More typical AN paranoid nonsense.  I have been treated extremely fairly whenever I have had police involved in traffic accidents (once my fault, once not my fault although the other driver tried to blame me).  Both were with Thonglor police who are notoriously bent.  Very fair, very respectful.

 

Use your brain and many reasons come to mind and they are nothing to do with dual treatment.  As others have mentioned perhaps he had been drinking and the Thai hadn't, perhaps he has no license and his Thai mate let him have a go at 5am, perhaps he has no insurance.

Perhaps he is fearful for his job as a serious offence can strip you of your WP so he asked the Thai to take the rap.

Please remove the chip from your shoulder, I don't know how you people carry them around with you.

Are vehicles in Thailand only permitted to be operated using the original tyres?    What are "racing tyres" anyway and which pictures are you looking at that show them in enough detail for you to determine their purpose?
