Phuket expat dies after being hit by ATV in the jungle

PHUKET: A French national has died after an American woman on an ATV tour lost control of her vehicle and hit the man and his motorcycle on Soi Klum Yang in Chalong earlier this week.

 

At around 4pm last Thursday (Jan 16), Lt Col Khanan Somrak of Chalong Police was notified that a foreign woman lost control of her ATV on a hillside track and hit another foreigner causing serious injuries to the latter.

 

Having arrived at the scene, police discover a red ATV and it's driver, a USA national Onome Alero Adeosun, 39. The woman was laying on the ground with her right arm and collarbone broken.

Of course it would. Protection of other's health an life and the obligation for operating dangerous machinery with common sense has priority over protection of people's right on their private property.

 

Well, at least in countries where rule of law is somewhat enforced and you are not in a country where people can shot you for trespassing.

What I do not understand, why is this always about blaming someone or attempting to assign blame then sue them. From the report this was nothing more than a very unfortunate accident. The gal will have to live with this the rest of her life. If they deem it an accident then that is the life of attempting extreme type activities in a foreign country. We all know the risks...or should.

Why even consider charges for the American woman in stead of the operator of the ATV business?

Probably because the owner of the business was not riding the ATV. Whilst he has broken several laws, nobody knows if the American lady had any ATV experience.

Actually was thinking the same thing - maybe I’m just too ancient and old fashioned and sometimes find all the abbreviations a bit tricky -  just having a small glass of B&B on ice - that’s an abbreviation I know well.

Quads or ATV do not exist in Thai law; they cannot be registered and therefore cannot be insured either.
the only place where you can use a quad is on private land;
however, for me, this soi ( a little street with no name ), whatever it is, is in the public domain, so this or these quads should not be driven on it.

the driver AND the owner of the machine will most certainly be prosecuted in criminal and civil proceedings.

Why even consider charges for the American woman in stead of the operator of the ATV business?

I imagine she signed the standard form before the ride and put all the blame on herself.
