These cons happen all too often with unwary tourists/investors losing all their money while the corrupt officials and land developers walk away with pocket fulls of cash, similar story to The Waterfront Suites and Residences in Pattaya.

PHUKET:-- MP Sira Jenjaka in Phuket in person today (Dec 21) delivered the order from the Supreme Administrative Court for The Peaks Residences condo project in Kata to be demolished as it is illegally occupying state land.

 

The Peaks owners have 30 days to comply, starting for the date of the court’s ruling, which was handed down last Thursday (Dec 17).

The Supreme Administrative Court last week ruled that the NorSor 3 Kor land document presented by The Peaks owners had been issued illegally.

Anybody who bought into this did not do due diligence. It was clear from the onset that this project is illegal as can be. And with projects here being declared illegal even years after construction, it is really not a very wise decision to invest/own there.

Hardly duped, I was offered this land back in 2012, It was then this land title it has now, and was offered at a rate of 15,000,000 THB.

 

The company behind the peaks have done very well out of it, knowingly i'd hazard.

Purchasing from the current glut of units would be safer than signing up for any new projects under development . Definitely a sucker bet when the money is only down payment on a promise.

Responding to the last few lines of your first post about overall investments being risky....Currently, new investors are being lined up in other projects without considering the possibility that something like "this Peaks project" could happen to them. The elite visa offer might also motivate other investors/victims  who would not normally to take the risk or be wise enough to do due diligence when signing up for any new projects under development .

A Thai friend of mine invested in a project that was never completed. He not only lost his investment but also a large amount of money paid towards legal actions filed to retrieve his money.

If the Thai government was ever serious about the demolition of any  building they would  simply  request a bid from contractors who  do such work and  then offer the contract to the contractor who fills a brown envelop the most.

 

They like bulging brown envelopes best. 

 

The Army can accompany the demolition contractors if necessary.   Simple..

In Bangkok, there was a similar ruling by the SAC to demolish at least part (the upper floors) of a ritzy hotel/condo called Aetas Hotel and Residence that was issued back in 2014. The building was ruled to have been built overheight for what should have been allowed on a relatively narrow street. The original litigation in the case dated back to 2008

 

AFAIK, the order still hasn't been carried out some 6+ years later after the final court ruling, and 12+ years since the case began.

"Issued illegally" and who issues these documents I wonder?

 

Officials at the land offices need to be investigated, because there have been rumours circulating for a long time about land documents being issued in Phuket (in general) when they shouldn't have been – – get my drift?

 

There have probably been quite a few folk been made very wealthy by this sort of practice.

 

And will the building be demolished.....well, TIT, so don't hold your breath.

 

As an aside, but related, I have been liaising with another poster on TV who appears to have been duped out of his house by what would seem to be "unusual practices" and he's having a hard time coming to terms with this, and no amount of suggesting that "this is Thailand" and just about anything goes, can help.

quite correct.

 

maybe it could be possible to challenge the land title in court, and if the court confirms it, it's legit...

For useless farmland it seems already pricey anyway after the title-deed status  was “adjusted”  surely the sale price of that landplot really exploded..

Not really.

About 15 years ago, buildable, seaview land in Patong was selling for around 4 million baht per rai. Now,  that same 4 million will buy 500 square meters of land on a dirt road behind a gas station.
