ANYONE, other than 45, who had 27 boxes of unauthorized and classified material in their private home would have been cuffed and perpwalked.

 

45 has been afforded infinite more grace than he deserves. The whining from the snowflake right is worse than the most woke teen. Perhaps we should be giving repubs and 45's cult coloring books to help them through the trauma.

Donald is not "anyone" though .

As POTUS , Donald had the power and right to determine which documents are classified and which documents are not classified .

   The President determines whether a document is classified or not . 

All Donald needs to do is to say that he declassified the documents and thats it, the documents are not classified .

   Yes, anyone else would be arrested for having those documents, but anyone else doesn't have the ability to de classify those documents

There was a process to go through and there is some debate about whether he did that. I strongly doubt it. He doesn't have the power to claim later that he declassified the documents without evidence that he did so while still president.

 

Furthermore, there is the potential that some of those documents could not be declassified at all.

This is false. Documents have to undergo a specific procedure to certify that they are declassified. 

 

Second a document is not declassified just because the president—or the head of the Public Interest Declassification Board—says it is. It has to go through a formal process, in which the security stamps, tags, or labels are removed. It seems at least some of the documents at Mar-a-Lago did not go through this process; according to the Journal, the FBI removed 11 sets of classified documents, four sets labeled “Top Secret,” one marked “Various classified/TS/SCI documents.”

Even if the documents were declassified it would still be a crime to remove them if any of the criteria of this law were met:

Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.
(b)
Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

As Donald was President at the time of their removal , he may very well have  had the authority to take the documents home , taking them home to read and study over the week-end .

1.  Are you arguing that it is technically legal for some of the most damaging information to the country that is available o be arbitrarily declassified and stored in a lax manner that would make foreign intel sources salivate at the possibilities?

 

2.  If the answer to the above is yes, are you ok with this?  Wouldn't it reflect poorly on any ex-President who is that irresponsible?

The warrant was granted on three suspected breaches of Federal law.

 

All of these are independent of any classification issues.

 

Obviously, DOJ was mindful of the de-classification ability of POTUS and that Trump might use it to try to muddy the waters and weasel out of the case.

 

The specific suspected Federal breaches are :

 

18 U.S.C. §§ 793: Gathering, transmitting or losing defense information, which carries a penalty of up to 10 years in prison.

 

18 U.S.C. §§ 2071: Concealment, removal, or mutilation generally, which carries a penalty of up to three years in prison and disqualification from holding office (more on this below).

 

18 U.S.C. §§ 1519: Destruction, alteration, or falsification of records in Federal investigations and bankruptcy, which carries a penalty of up to 20 years in prison.
