An investigating committee has recommended the Election Commission to drop the charge that Move Forward party leader Pita Limjaroenrat violated the election law for allegedly holding shares in a media firm while filing candidacy in the May-14 election.

 

According to an informed source at the Election Commission (EC), the committee found there is no clear evidence that iTV was operating and earning income at the time when Pita applied for his election candidacy in early April.

 

The committee pointed out that, in order to disqualify Pita, in accordance with Section 151 of the Election Act, evidence that he still held shares in the media company must be clear and beyond any doubt.

And what are the consequences now??? a lot problems for nothing as stated by Pita already.... New chance for Move Forward Government ?? Can Pheu Thai going on with his deals?? New elections maybe now?

The Move Forward Party will not vote for the Pheu Thai PM candidate, as stated by Move Forward Party Secretary-General Chaitawat Tulathon.

 

He mentioned that the party's MPs have reached a consensus on this decision.

 

Furthermore, he emphasized that the formation of the new government diverges from the people's mandate given during the election on May 14.

 

He clarified that the intention behind this government formation is not to diminish the senate's authority, but rather, it is aligning with the desires of senate and junta-backed parties to prevent the Move Forward Party from assuming power.

EC unlikely to drop the case as they have already forwarded its recommendation to the Constitutional Court. If he drop the case, EC can be charged for malfeasance. In any case, this shareholding case will only get Pita disqualified as MP. A bigger case of attempting to overthrow the democratic system will get him and party executives banned and dissolution of the party. That will be devastating to the future of the party.

They achieved what they wanted to do, removed PIta from the equation.

PTP got the reins and very quickly showed their true intentions.

Even their own ardent backers are shocked.

Forget Thaksin coming back, he'll probably get stoned rather than cheered.

"The committee’s findings and recommendation have been sent to the secretary-general of the Election Commission, said the source, adding that the case will then be forwarded to a sub-committee for consideration, when Pita may be asked to testify to the panel.

The source also said that the panel may delay the case until there is a ruling from the Constitutional Court on Pita’s parliamentary status as relates to the iTV share ownership."

 

So the EC's (investigating) committee has sent it's report to the EC secretary general who will forward it to a sub-committee, aka the panel, who may ask Pita to testify, but not until the CC has ruled on Pita's parliamentary status regarding iTV share ownership.

 

What complete cobblers. EC bureaucrats, getting paid for doing nothing.

How far down the "rabbit hole" do you have to go before a political party which campaigned openly on a platform of reforming laws and economic practices which are extensively used to restrain free speech and constrain and control economic and political opportunity for much of the population, and which won a significant proportion of the votes on just that basis, can be prosecuted and dissolved for attempting to overthrow democracy?

 

A rhetorical question of course - the entrance to the rabbit hole was marked years ago with the formation of committees of Generals and Police Chiefs for "peace and order" and trumpeting slogans about "the democratic Army"!

 

Dissolving Move Forward and banning it politically is in the short term disastrous, as it will disenfranchise over 30% of the electorate. But then the political classes seem determined to ignore their voice anyway! However in the medium and long term it will probably be to the progressive movement's advantage. Move Forward and it's predecessor, Future Forward, are the manifestation of a popular movement, rather than a political ideology, or as in Thailand so often a political patriarchy. As such the aspirations and ideals of it's supporters, whilst they may be denied will not go away, they are likely to become more determined, more vocal and more numerous. Each year a fresh tranche of 18 year olds will join it's ranks.

When has the EC ever been charged for malfeansance?

• When PM YIngluck absolved the House in 2013 to trigger a new election that was required constitutionally within 60 days, the EC said it couldn't be done. 
• When NCPO cancelled the 2014 election redo and suspended further elections for four years, the EC stood silent and only for the grace of the NCPO extend their terms and continued to be fully staffed.

It's more likely that EC will drop the referral as it relieves the Constitutional Court of making any legal opinion. EC can go back to its original pre-election examination that held Pita to be an eligible candidate.
