Jury finds Trump liable for defamation of Carroll and awards nearly $3 million

A jury in Manhattan federal court found Donald Trump liable for defamation in a civil lawsuit brought by writer E. Jean Carroll.  

Trump should pay nearly $3 million in damages to Carroll for successfully proving her defamation claim against him, the jury found. 

It also found that Trump should pay about $2 million in damages for her civil battery claim, bringing the total to $5 million.

Trump, who has denied any wrongdoing, did not put on a defense and ultimately opted not to testify. Like any defendant in a civil case, he was not required to appear in court for trial or any proceedings and has a right not to testify in his own defense.

And at the same time, the same guy is telling rioters to storm the capitol, they do that, people die, and there are no legal consequences - at least until now.

Do we have to wait another 30 years before someone will sue him for that and demand compensation?

 

I would love to see Trump in jail and lose all his money. But this case is just laughable.

I take your point but you weren't in the courtroom to hear the evidence, to build a picture of the character of Ms Caroll, to hear her words and the words of those who confirmed that she made such claims at the time or a relatively short period afterwards, the potential similarities with claims of many other women, and of course Trump did himself no favours with the total arrogance of his interview for the case. 

Keep in mind too the bigger part of the finding is actually for defaming her.

Donald Trump's attorney Joe Tacopina called the jury's decision in the civil trial Tuesday a "strange verdict," noting that the jury rejected the rape claim against his client.  

 

While the jury found that Trump sexually abused E. Jean Carroll in 1996, sufficient to hold him liable for battery, the jury did not find that Carroll proved he raped her. 

 

Tacopina, speaking outside the Manhattan courthouse, said that they would "obviously" be appealing the verdict.

Not even Jonathan Turley who backed Judge Aileen Cannon's bizarre decision to appoint a special master in the Mar a Lago documents case and who believed that John Durham had strong cases to make, thinks Trump has much chance of succeeding in overturning the jury's verdict.

"But when it comes to factual determinations, the court of appeals tends to be leery of overturning those. Jury decisions are really sort of iron plated because you have to show that they were clearly erroneous. They're not going to be able to show that here with all this testimony."

I understand that the public and a jury might think he is the kind of guy who would do something like that. But did he? Did he do it at that time with that woman? There is no evidence.

 

And should he be punished for something he might have done because that would be in line with his character? Without any evidence I don't think so.

You are aware that civil trials are not criminal trials and so the main case was his defamation of Carroll.  So many other cases to be heard still.  His appeal will go nowhere as his deposition which the jury was made aware of basically sealed the verdict. No defense was needed for what they convicted him of.

Yep, it's insane this happened. Whatever a person's feeling toward Trump is, you can't deny this is insanity.

Defamation is a crime. As you said he should have kept his mouth closed, but alas tis the Donald we discuss........

A truly great victory for mankind, morality, truth, justice and an enormous humiliation for the goombah. Though he will attempt to turn it into "they are all against me, and this is just another witch hunt". 

 

Hey Don. You lost. It took the jury only 3 hours to determine your guilt! You are a rapist. That much is clear. Too bad they were not able to get a criminal rape conviction. Only prison is good enough for you Don Don.

I understand that people don't like Trump and want to see him punished, any way possible.

 

But how would you react if something like this would happen to a nice celebrity? Or to your father?

He is guilty because a jury of his peers, who have seen the evidence, said so.

Why do you keep on claiming he shouldn't have been convicted without having seen the evidence?

She had witnesses who confirmed she told them about it after it happened. I would say that Trump did himself no favors by not appearing in court. But given his lack of self-control, as shown in his deposition, his attorneys probably had no choice but to keep him way. And this volatile ball of unhinged rage has the backing of right wingers to be President again.

 

Trump has spent a lot of money on leg overs
